Barrow maintains there is factual guilty, but not legal guilt in respect of Elvin Penner

And that brings us to the man at the centre of the scandal, former Minister of State Elvin Penner. According to PM Barrow, any suggestion that there is a cover-up is simply not true. In fact, he says, the ball is in the D.P.P.’s court and any decision to prosecute or not lies with her. Still, he maintains that while there is no doubt that Penner is factually guilty, proving him legally guilty is another matter entirely.

“The Director of Public Prosecutions has been given the file by the police. My understanding is she has asked for further steps to be taken, further statements to be recorded; that I think may now has been done. It is for the Director of Public Prosecutions, who is constitutionally charged with that responsibility to determine whether there is enough evidence that will sustain a criminal prosecution. I got into trouble with the media right at the start when I tried to make the simply point that there is a difference between factual guilt and legal guilt. We all have no doubt in this case about the factual guilt, but what you need in accordance with the rules of evidence, to be in possession of, so that you can go to court and make a case is all together a different matter. But please, understand that if the Director of Public Prosecutions ever thinks that she has the kind of material that will allow her and therefore the state to charge Penner, let justice be done.”

 

Elvin Penner returns to court on June twenty-sixth, when it is expected that there will be a disclosure of the evidence against him. We’ll have more on the press conference later in the newscast.

    What horse dung Barrow spews!!! The evidence is factual that Penner broke the law. The evidence must be admitted in a court . Penner is guilty if the evidence is demonstrated in court. Barrow speaks horse sh-t.
