According to Williams, there was opportunity for settlement but the legal issues surrounding the claim are complicated enough, involving issues of both public and private law that need to be resolved in court.

“The case has been brought by Mister Feinstein to the court so you simply have to deal with it; that’s the appropriate forum. It is not a matter of what else could have been done. He is the instigating litigant, so to speak, and he has brought it in his forum and so it has to be addressed. Of course parties are always free to come to terms otherwise. It is a public law issue, but it is combined with the ancillary claim, which is a private law issue. So it is like how you would say, beef and pork kinda chopped up and mixed up. So it is quite complicated. It is the public law/private law in one…kinda like wearing your snickers and your shoes—one foot a snicker, one foot a show kinda thing. But it is interesting, but that is just the nature of the case. You can only tend to have private law dispute go to mediation, but public law issue, you are talking about not just the litigant’s right but the public interest.”
