Calaney Flowers Will Stand Trial for Murder

It was big news in August, 2012 when Calaney Flowers allegedly rammed a motorcycle ridden by her ex-boyfriend Lyndon Morrison and his new girlfriend Sochyl Sosa. Morrison died from injuries sustained in the collision while Sosa was badly injured. Flowers was subsequently charged for murder and attempted murder and remanded. It’s now before the Court, and last week Flowers’ attorney Arthur Saldivar filed a no-case submission. If Justice Troadio Gonzalez upheld that submission, Flowers would walk free. But today Justice Gonzalez ruled that he is satisfied that Flowers does indeed have a case to answer. As he exited the Courtroom, attorney Arthur Saldivar explained why he felt that his client should have been a free woman today.

“The prosecution is claiming the offence was committed was in relation to the use of motor vehicle where the prosecution is not showing that there is any point of impact on the car to show where it collided with the cycle; then there is no case to answer. In that regard, the submission was put before the court. There were two witnesses who did suggest in their testimonies that they saw a collision. On a prima facie basis, it is appreciated that that may be enough to ask or to call on the accuse to answer. Whether it passes the test of guilt beyond reasonable doubt is another question because then I guess more scrutiny will have to be placed then on the car and what evidence exist to show that that car was in fact involved in a collision. As I said, this car is a Saturn—I believe most people in Belize know what a Saturn is—it’s a small car. It has a plastic bumper; the bumper is intact, the headlights are intact. It doesn’t suggest to me that it was a car that was involved in a high speed collision. A car of that nature would be totally mashed up. I mean if you hit a cow or a horse on the road which is made of tissue and bone, it will mash up your vehicle, much less a motorcycle that is of the size of a ninja 600 or whatever it is. So it doesn’t seem to me to be a case where Miss Flowers was in fact involved in a collision. It could have been, from all the suggestions in the court, a head on collision with a pickup truck that was coming out of the entrance of the Central Assembly of God gate, because the examiner from the police, the mechanic is saying that the front of the bike was bent in. So that’s where we are with this and that’s where we are going with it in terms of a defense for Miss Flowers.”
