Despite Sylvestre’s objection that the document ought not to be entered into the proceeding, the Chief Magistrate ultimately decided on its admission.

“We did make strenuous submissions as it relates to why we believe that that ought not to be, but at the end of the day the learned Chief Magistrate has made her decision so we move on to next week Tuesday and to see how matters proceed from there.”

 

Reporter

“Sir, is it safe to say that preliminary inquiries begin next Tuesday?”

 

Anthony Sylvestre

“I suppose you can say that.”

 

Reporter

“Sir, the D.P.P. said in court that you seem to be hopeful that your client would walk out of here today based on this document issue.”

 

Anthony Sylvestre

“No, of course not.  That was just an aside, I don’t think that that was said in all seriousness.  No, this is a court of law and legal submissions are made to the court and at the end of the day when those submissions are upheld, whatever party that those submissions are upheld they then see how they could navigate with the continuation of the trial.  So as it relates to the decision that was made this morning, that was made on behalf of the government and so, as I indicated earlier, we’ll see what happens next week Tuesday.”

 

Reporter

“So then the issue, can it be brought back during the PI?”

 

Anthony Sylvestre

“This issue is one which is a live issue and it is one that we do intend to raise at the relevant time, yes.  So, to answer your question, yes.”
