Bar Association Ask Court to Declare Commission’s Decision Unconstitutional

The Bar, according to Marshalleck, is asking the court to rule that the decisions that the commission took over the past two years are unconstitutional and should be reversed. He says that because the commission was not properly instituted, the decisions are invalid.

“We say that those decisions are invalid. They are unconstitutional because they Judicial and Legal Services Commission which considered those issues and made those decision was not properly constituted in that the duly qualified members were not invited to attend and didn’t get an opportunity to participate in those decision. The President of the Bar represents the views of the Bar generally in these types of decisions. They have proceeded for the last two years with all of these decisions without any input whatsoever from the Bar association which is lawyers generally.”

 

Reporter

“Doesn’t that mean that that’s two years of decision that needs to be reversed?”

 

Andrew Marshalleck

“Of course and they should have thought about that when they went on for two years without the president.”

“That is what you are asking the court to do, the remedy that you are seeking?”

 

Andrew Marshalleck

“Yes. One of them is to recognize the invalidity of those decisions.”

 

Justice Arana has reserved her ruling to a later date.
