A Twist in the Elmer Nah et Al Ammo Trial
The ammunition case before Senior Magistrate Baja Shoman against Elmer Nah, his common-law wife Epiphania Caliz and his brother-in-law Manuel Caliz took an interesting twist today. The trial continued with the defense presenting its case, the judge was forced to make an adjournment after Nah’s wife took the stand as witness for the defense, even though she is a defendant in the case. It appeared to be a conflict of interest and the crown made objections, so Senior Magistrate Showman adjourned the matter to research on law that allows such proceedings before making a ruling as to how the matter will continue. Defense attorney Leeroy Banner says that while it formed part of the defense case, it opened the door for objection by the crown. The ammunition charges stem from a November sixth, 2021 search of a vehicle that the three defendants were travelling in. Epiphania’s testimony spoke of a video recording that prosecutor, Head of Prosecution Branch Alifah Elrington objected to because she alleges that the defense attorney is trying to have it entered into evidence through the witness. The matter was adjourned until June twentieth, 2023 when a decision will be made.
