High Court Grants DCP Bart Jones Leave for Judicial Review
Earlier today, the High Court of Justice Genevieve Chabot handed down a decision in respect of a matter filed by Deputy Commissioner of Police Bart Jones against the Security Services Commission. DCP Jones applied for permission to seek judicial review of a decision taken by the Security Services Commission to promote Doctor Richard Rosado to the post of Deputy Commissioner of Police with effect from July first, 2021. Jones, among other things, is also seeking judicial review for an order of certiorari to void the specific portion of the decision of the Security Services Commission in which Doctor Rosado was promoted to the post. Likewise, he is seeking a declaration that the decision is a nullity as there was no vacant post of Deputy Commissioner of Police that existed on July first, 2021 and Doctor Rosado did not qualify for promotion as at that date. Jones is also seeking vindicatory damages for breach of his constitutional rights. In her decision, Justice Chabot ordered that Paragraph Eighteen of the Second Affidavit of Bart Jones dated July seventh, 2023 be struck out. Jones now has fourteen days as of the date of the decision to apply for judicial review.
