Selgado will Learn His Fate on February Seventh

A decision in the case involving attorney Oscar Selgado, who stands accused of abetment to commit murder, will be handed down by the High Court on Wednesday, February seventh.  Earlier today, the Director of Public Prosecutions indicated to Justice Nigel Pilgrim that several points raised by attorney Adolph Lucas Senior, who represents Selgado, are not applicable to a no case submission.  The DPP argued that the judge is the one who decides at the end of the trial whether the statement tendered by Giovanni Ramirez is credible.  She then put forward to the court that the only matter before the judge in a no case submission is whether there is enough evidence, or whether the evidence available is essentially weak, vague or inconsistent with other evidence.  Director of Public Prosecutions, Cheryl Lyn Vidal argued that there is sufficient evidence before the court to return a guilty verdict.  On the other hand, the defense holds that the evidence is inherently weak.  Likewise, the defense argued that the voice in the audio recordings have not clearly identified Selgado as the speaker because there was no ID parade.  The DPP, for her part, refuted that position, stating that circumstantial evidence can also lead to an identification and there is sufficient evidence in this case.
