Alburn Plunkett walks free of Murder charge
And in another case in the Supreme Court, one more witness refused to testify at a murder trial, and the accused also walked free. Twenty- five year old Alburn Plunkett, who was charged with the 2006 murder of Cassius Myers, was freed of the charge today in the court of Justice Adolph Lucas when crown Counsel Nadine Palacio entered a another Nolle Prosequi saying the prosecution could not continue because the chief witness, Jason Usher, refused to testify. Usher told police that he would not testify a second time because he was threatened. The police had Usher in custody this morning for his own safety. Usher had testified at the first trial on February thirteenth, 2008 for which Justice Michelle Arana ordered a retrial after it was discovered that one of the jurors was Plunkett’s aunt.
On December eighth, 2006, Myers was standing on Vernon Street in front of a Chinese shop near Conch Shell Bay when two men riding on bicycles approached him. According to one of the men with Myers, one of the cyclists pulled out a pistol and fired several shots. When Myers fell to the ground, the gunman stood over him and shot till the gun was empty. Myers was hit nine times and one of the bullets struck him in the middle of his forehead. He was pronounced dead on arrival at the Karl Heusner Memorial Hospital.
