Defunct garbage firm one stop closer to collecting over a million dollars
A major ruling was handed down in the Appeals Court this afternoon by Judge Manuel Sosa. Sosa ordered the Commissioner of Sales Tax and the Attorney General’s Ministry to hand over one million seven hundred and fifteen thousand dollars nine hundred and seventy one dollars and thirty five cents to the Barrow and Company by Monday. The law firm represents Sanitation Enterprises Limited (SEL). On September twenty-fourth 2010, SEL won a judgment against the government but no limit was put on when the money had to be paid. So SEL had to return to court to seek a definitive time. And on December twenty-second 2010, Justice Legall ordered the transfer of the funds but the Financial Secretary Joseph Waight, indicated that the expense was not included in government expenditure for the financial year. Since funds had dried up for the financial year, Waight wanted the Appeals Court to grant a stay of execution of the Judgment Order pending the determination of the upcoming appeal which is expected to be heard on March eighth, 2011. Justice Sosa said that while that appeal may arguably have some prospect of success, he didn’t think that the Commissioner of Income Tax stands to be ruined, absent a stay. But SEL, despite the ruling, won’t get any of the funds as it will be held in the account of Barrow and Company.
