DJ Whiz sentenced to 9 years for rape
His sensational case has been before the courts and in the media since 2007 and two weeks ago on September ninth, Lewis Leiva was convicted of raping an eighteen year old American tourist. But it wasn’t until today that the thirty-eight year old DJ and hotelier learned his fate. Justice Adolph Lucas this morning sentenced Leiva to nine years in prison after mitigation pleas from a pastor, several businessmen, a librarian and even Channel Nine owner, Ramon Vasquez, but his wife never spoke on his behalf. Interestingly, Leiva’s attorney, David Moralez, asked the court to impose a non-custodial sentence, but considering the charge Justice Lucas informed him that it was neither possible nor practical. The justice also noted that the tourists were guests at Leiva’s Red Hut Inn and the victim’s level of intoxication made her unable to consent to sexual intercourse. The teen and her sister checked into the Red Hut Inn on July tenth and two days later, they went to a party at the same location. Both women returned to their room. Leiva went to the room with the pretext of saying goodbye. This is when the rape occurred.
