Three times and she’s out; Corozal woman acquitted of the murder of her brother

Tiffara Smith

A Corozal woman who had been tried three times for the murder of her brother was acquitted today. Twenty-two year old Tiffara Smith was only seventeen when she allegedly stabbed her older brother during a dispute about a pack of Ramen noodles and ten dollars. The case depended on a 2007caution statement given to Police Constable Elizabeth Thompson, in which Smith allegedly confessed to the murder. But Thompson is out of the country and for the statement to be entered as evidence; her mother would have been required to appear in court to explain that her daughter is not in Belize and is therefore unable to testify. But Senior Crown Council for the DPP’s office, Cecil Ramirez, was unable to arrange that testimony and Smith’s attorney, Simeon Sampson, made a No-Case submission. Justice Denis Hanomansingh upheld the submission and directed the jury of twelve to acquit Smith of Murder.

The stabbing occurred on April twenty-fourth 2007 when Smith and nineteen year old Dale Lino were at their house on Second Street in Corozal Town. The siblings got into an argument because Smith accused Lino of stealing a pack of noodles and ten dollars from her room. During her first trial in 2008, Smith claimed that she asked Lino about the stolen money and he laughed at her, causing her to lose her temper and stab him. That case thrown out because Smith had fallen ill and a retrial was ordered. In the second case in 2009, Smith gave a conflicting recount of the incident, claiming that it was in self defense because Lino choked her after she confronted him. She was convicted and sentenced to life in prison, but she successfully appealed that decision and was granted a second retrial, which ended today with an acquittal.
