P.U.P. Attorney says judicial review of Penner recall petition still stands

Anthony Sylvestre

There was another issue that came up in the P.U.P.’s press briefing earlier today. It involves the Elvin Penner recall petition put in motion by the Party, but rejected on December thirty-first by the Elections and Boundaries Office. The rejection came on the basis that it did not meet the threshold of valid signatures. The P.U.P. has indicated that it will seek judicial review of that decision. Legal Advisor, Anthony Sylvestre, says that one thing has nothing to do with the other, and this recent legal hit against Penner is a totally separate matter.

“One of the major planks of this, the Prime Minister’s campaign manifesto was accountability and transparency so that it is very important that we get to the bottom of what all…because we don’t know. There are many other things that may have been done—that Penner and who else may have done—and so that aspect is different from the initiative that started with the recall. And you asked with respect to an update with that, we have until the ending of March to file that judicial review proceeding with respect to the rejection by the Governor General in relation to that recall mechanism and that is still in the process. That certainly will be filed by the latest by mid-March.”

The petition failed to meet the threshold by seventy-nine signatures, after the Elections and Boundaries Office disqualified those persons whose signatures, though valid, were found to be duplicated.
