Where is the Penner file? ComPol says he doesn’t know…

The Commissioner of Police Allen Whylie has finally spoken about the investigation into the immigration scandal involving former Minister of State, Elvin Penner. A writ of mandamus instructing Whylie to formally commence a criminal investigation of Penner was issued by Chief Justice Kenneth Benjamin on March third.  The order from the Supreme Court came seven months after the Penner passport scandal first made headlines.  While there was public outcry as to why the Cayo Northeast area representative had not been investigated, arrested and charged in the wake of facilitating a fraudulent travel document to Korean national Kim Wong Hong, ComPol Whylie and the police department remained static. Since then, a file compiled by the Director of Public Prosecutions outlining the various offences committed by Penner in relation to the issuance of the fraudulent passport remains in limbo.  According to ComPol Whylie, he doesn’t know where the file is.

 

Reporter

“How did you feel about the fact that the chief justice basically scolded you and told you that you should do your job which you weren’t doing?  What was your reaction to that?”

“Well I disagree with you Jules in terms of being scolded and saying I’m doing my job or not doing my job, you know.  Those are legal issues and that matter is being addressed legally, as you know an appeal has been filed and we wait to see the outcome of that.”

 

Reporter

“Sir, we know that the D.P.P. has told the press that she has requested that the file be returned to her, the Elvin Penner investigative file be returned to her and at that point she would share it with COLA and their attorney who are doing a private prosecution.  Why has the file not been returned to her and how do you all feel about sharing the file with a civilian, actually a police investigative file with a civilian organization?”

 

Allen Whylie

“Well Jules, what you are sharing with me is news, I’ve heard nothing from the DPP in terms of she has requested the file to share.”

 

Reporter

“It’s a matter of fact, she’s gone on the record and said that in fact she has made an undertaking to share it with COLA.  Are you willing to entertain that, that a police investigative file be shared with COLA for a private prosecution?”

 

Allen Whylie

“It’s not a decision from me, once the file is sent to the D.P.P. if she sees fit then that is her.  If she has the authority to do it that is fine.”

 

Reporter

“Okay, so where is the file now?”

 

Allen Whylie

“Well, I’m not sure if the file is with us or with her.  I am not sure.  The last occasion I know the file had been submitted to her.  She hasn’t sent it back to me.”

 

Reporter

“Okay.  So, but the investigation is ongoing?”

 

Allen Whylie

“Yes, the investigation is ongoing as far as I am aware.  I know it was submitted to her and if she gave any directives or she has returned it I am certain that those will be pursued.”

    not a surprise we saw it coming from mr. whylie, these high ranking people seem to think we’re fools but we know exactly what they are going to do next, as soon as they come up with some lame excuse and lame press release. Every one knew this was coming but really do they think that the world ain’t watching, I’d be shame if my dad would be someone like that mein really.

    This is an important statement the Commissioner made. He is saying indirectly that he has no authority to share the file, so if she has the authority to do it that is fine. So who has to give the authority for the file to be shared, because he compol don’t? These are the little games people play when they don’t want to comply. Do we need to believe that it is John, and the PM that has to give this go ahead?

    Whylie should be stripped of his rank and should be disgraceful dismiss for non performance with no benefits… it is an outrage that the captain of a boat does not know his ship and or how to navigate it. Shame on Barrow, shame on all of us who tolerate this none sense. Imagine, how can we believe in the law? How can we trust in the law and that we shall be protected? They are our brothers and sisters keepers… FIRE Whylie and charge him with something damn it… set an example!!
