Injunction Hearing Set for Friday

And while the application for the order of mandamus is one thing, there’s also the matter of the application for an interim injunction to prevent the B.S.C.F.A. from signing any agreement with ASR/B.S.I. The court has set Friday as the date for a hearing on that injunction. But the B.S.C.F.A. has agreed to go to the AGM on Sunday, so the injunction hearing, strictly speaking, should not happen…at least according to B.S.C.F.A. Chairman Cansino.

“Well we are expecting this application for injunction be retracted because we will be having the special general meeting because it is specifically clear that if we go to this special general meeting, they will remove this application.”

“We got notice today from the Court that the hearing for the injunction will be Friday. So it is matter to discuss and see how things are going. We can actually get an injunction to stop any signing. We will discuss what we will do because the special general meeting is Sunday and we are also hoping that having sent in the application as an urgent application that we can also have the hearing for the permission for the mandamus Friday as well. So Friday will be a critical point as we will decide what will happen next.”

“The fundamental reason you request an injunction is really to prevent the Committee of Management to sign the agreement without going further for consultation with the membership because many cane farmers do not agree with the agreements as it stands. We believe that it is contrary to our interest and that is the reason we believe that we are losing all our interest if the agreement is signed before we have further consultation with the general membership. That’s one point here.”

“So in a sense, the strategy as Misses Matura-Shepherd says, you are a strategist; it has worked. It has forced the B.S.C.F.A. to go back to the AGM on Sunday. But if when they do that, the farmers still say we want to sign the agreement?

“Then I believe that democracy should prevail. If majority says we go even knowing the risk can be detrimental to our interest, we cannot stop them.”
