D.F.C. drops court action; will comply with subpoena
The drama over the D.F.C. Commission of Inquiry has apparently ended… not with a bang but with a whimper. Today in the Court of Chief Justice Abdulai Conteh the D.F.C., through its attorney Michel Chebat, dropped its case against the Commission and agreed to comply with the summons issued to D.F.C. Chief Troy Gabb, who will now provide all documents and testimony sought by the Commission of Inquiry.
In his judicial comment, Justice Conteh remarked that had he been asked to rule on the case–which pitted the Commission’s subpoena power against the D.F.C.’s confidentiality clause–he would have ruled in favour of the Commission. In a press release late this evening, the D.F.C. claimed its resistance to the subpoena was based, not on any desire to impede the investigation, but solely to comply with the legal requirement of strict confidentiality in its dealing with clients.
