Gales Point’s Artie Myers to be Retried for Child Sex Accusation

This afternoon at two o’clock, three judges of the Court of Appeal handed down a written judgment in favour of convicted prisoner, Artie Myers.  The Gales Point Manatee resident was charged in November 2012 with the carnal knowledge of a young child and convicted in October 2015.  Today, Justices Sir Manuel Sosa along with Christopher Blackman and Murrio Ducille ordered a retrial since in their view Myers did not get a fair trial. The court found that the virtual complainant had evaded a number of pertinent questions, included when she was asked about the date of the incident, she could not remember it.  Justice Manuel Sosa was of the view that the minor, even after having been allowed to refresh her memory by reading the previous statement, she showed no desire to cooperate with the prosecution.  And even as the victim was treated as a hostile witness, her statement was allowed into evidence against Myers and that lead to a conviction.  Today, the justices noted there is no indication in the record that the judge took the steps dictated by established practice to demonstrate that the thirteen year old understood the nature of an oath.  Myers was late for the handing down of the judge’s written judgment.  But he said in an interview that he is optimistic that at his retrial he will be vindicated since the minor was telling lies about him.  Myers got bail in October 2015 when the matter was first heard.
