No Bail for Murder Accused Daniel Myvett, Facing Retrial

Supreme Court Justice Marilyn Williams says she cannot offer bail to accused murderer Daniel Myvett, who is awaiting re-trial on the charge of murder. Myvett is accused of killing Nigerian national, Kabiru Olongundudu, a security guard working and posting at the Best Western Belize Biltmore Plaza, who was stabbed to death on the jobsite during an alleged robbery. In delivering her decision, Justice Williams said that Myvett, in her view, has no special circumstances listed in arguments by attorney Alifa Elrington that would qualify him for bail. Since he is awaiting re-trial after a hung jury, the judge said, that does not constitute undue delay in hearing his case. Myvett has been in jail for three years since his case was tried in 2015. Myvett was originally charged with Deshawn Mena and Jamal Jackson, who were acquitted. Exactly eight years and ten days ago, Oloungududu was both shot and stabbed in what was reported to be a plan to rob the Biltmore. The primary witness who was given immunity recanted his original police statement which led to the arrests of Myvett, Mena and Jackson on the witness stand, but trial judge Troadio Gonzalez allowed the original statement as evidence. Other evidence against Myvett included that he had a personal misunderstanding with the victim and stabbed him while the others shot him. The court previously granted bail in the case of Nelson Henry, charged in the murder of Edward Lord and later acquitted.
