Dwayne Davis Guilty of Manslaughter of Doctor
Back to the court…Thirty-seven-year-old Dwayne Davis on Thursday admitted to causing the death, though not intentionally, of fifty-two-year-old Doctor Ivan Enrique Garcia Gomez, a naturalized Belizean originally from Guatemala, in June of 2012. Davis pleaded guilty to the lesser charge of manslaughter during his trial which began on May third. He told police that he was invited to a residence in the King’s Park area on the evening of June seventeenth, 2012, to socialize with several other persons including Garcia. They left that residence for Garcia’s home around eleven p.m. where Garcia made sexual advances on him which were refused. The following morning, Garcia tried again, but Davis refused and the men began to struggle. Davis said he forced Garcia to pass out at least twice in a submission hold, but he regained consciousness each time and continued to advance on him. Ultimately, Davis used a can of beans to knock Garcia out. According to Davis, he never intended to hurt Garcia. In addition to Davis’ confession statement which Justice Adolph Lucas admitted into evidence, his finger prints were lifted from inside Garcia’s apartment and a DNA sample from Garcia’s right hand fingernail was matched to Davis. The accused was represented by Bryan Neal and will be sentenced on June fourteenth, 2018 after the court receives a report from the prison and a social inquiry report. The prosecution was represented by Crown Counsel Portia Ferguson.
