Sentence Deferred for Dwayne Davis, Guilty of Manslaughter
Thirty-seven-year-old Dwayne Davis remains behind bars tonight pending sentencing. Davis was charged with the 2012 murder of Doctor Ivan Garcia but pleaded guilty to manslaughter. He was to be sentenced today, but Justice Adolph Lucas delayed his decision until next week Wednesday, after hearing mitigation pleas from Davis, his attorney, Bryan Neal and one character witness, Lauren Garbutt. Davis denied he is gay or bisexual and said that Garcia was not his lover and that on the day of the incident he had tried to defend himself. Garcia, a Guatemalan national, lived in a Belama apartment where he was found dead after being strangled and hit on the head with a can of beets. The court heard that prior to his killing; Davis and Garcia were at the house of another doctor and had then gone to the doctor’s house where Davis claimed he refused Garcia’s advances. Davis says he fought him off several times and eventually struck the doctor with the can of beets. Davis has a more days to learn his fate.
