Elario Elijio is Freed of Manslaughter Charge
Tonight forty-year-old Elario Frank Elijio was also freed after an appeal filed against him in February of this year challenging his acquittal was discontinued. Elijio had been acquitted of the murder of his buddy, John Myers, which occurred in late February 2012 on Mahogany Street. On February twenty-eighth, 2019, the Crown submitted a notice of abandonment. During Elijio’s 2016 Supreme Court trial, his then attorney Alifah Elrington made a no case submission before Justice Troadio Gonzalez which was upheld and Elijio was acquitted. Myers was drinking with Elijio at Qin Shop on Mahogany Street; they became embroiled in an altercation and he was punched in his face. Myers fell and hit his head on the cement pavement and died on the spot. Two grounds of appeal were filed in which Elijio’s attorney claimed that Justice Gonzalez had erred in law when he concluded that evidence by the crown to prove its case was insufficient to establish a prima facie case against Eljio. Second, that the judge also erred by improperly exercising his direction by not allowing the crown to stand down the matter to enable the testimony of a witness who was travelling from a district. And by that denial, the crown was unable to place all its evidence before the court.
