Fuller’s attorneys want another justice to hear their case

Rhett Fuller’s attorneys have taken their client’s cause to the Supreme Court, but today they asked Justice George Meerabux not to hear their application for a writ of Habeas Corpus, or the right to bring their client before the court to determine if his detention is lawful. Senior Counsel Eamon Courtenay and attorney Kirk Anderson did so because in November Justice Meerabux heard Fuller’s application for bail. He also made a finding of fact in respect to an issue the attorneys will be dealing with in the Supreme Court matter. To avoid the appearance of bias the attorneys say they are asking that another justice hear the case. Courtenay says Justice Meerabux told them he will let them know his decision on Tuesday April 6th. The United States is asking that Rhett Fuller be extradited to Florida to stand trial for a murder committed in 1990. Fuller has maintained that he was not involved in the incident and that the United States authorities have known of his whereabouts for the last nine years. In February Chief Magistrate Herbert Lord ruled that there was sufficient evidence for Fuller to be extradited to stand trial. His attorneys immediately made an application to the Supreme Court. Fuller has been at the Hattieville Prison since October 21, 1998.
