Waterloo Seeks Permission to Apply for Judicial Review in DOE/Portico Matter
A notice of application for leave to apply for judicial review has been filed by Waterloo Holdings Limited, Belize Cruise Developments Limited, and Belize Logistics Terminal Limited, against the Department of Environment, NEAC and Portico Enterprises Limited. The applicants are all the intended developers of the cruise and cargo expansion project envisioned at the Port of Belize. The Department of the Environment is the first respondent, the government agency that is empowered to enforce the Environmental Protection Act, as well as the Environmental Impact Assessment Regulations. Waterloo is seeking, among other things, a declaration that NEAC’s decision approving environmental clearance for the Port of Magical Belize, in the absence of meaningful and substantial consultation with the applicants and the public as required by the Environmental Protection Act and the E.I.A. Regulations and the constitutional duty to genuinely consult, is unlawful, null and void.
