Bart Jones Seeks Damage for Harm to His Reputation
We also asked attorney Lindo if the decision to promote Doctor Rosado retroactively would have any bearing on the appointment of a new Commissioner of Police when that time comes. Here’s how he responded.
Isani Cayetano
“Is that decision affected by the appointment of a new Commissioner of Police somewhere down the road to say that perhaps Dr. Rosado is now first in line over Mr. Jones?”
William Lindo Jr., Attorney-at-Law
“Well, that one I can’t necessarily comment on because, as you know, the Commissioner of Police is a Section 107 appointment, Section 107 of the constitution. So that’s really for the prime minister to decide and consult with the Leader of the Opposition and then get the approval of the Governor General.

“What are the damages, if any, that are being sought here by your client?”
William Lindo
“Well, Mr. Jones is seeking damages, general damages only because, and mainly for the harm to his reputation and, as it were, the ridicule that he’s being subjected to by Dr. Rosado now senioring him in the police department. The judge found that the [Belize] Advisory Council does not have jurisdiction in a case where a public officer is challenging the promotion of another public officer. The judge ruled that in those circumstances the [Belize] Advisory Council would not be able to entertain an appeal.”
