Kaseke: Mayor’s inflammatory statement was not against PM
But while today’s case was on the legality of the meeting of the National Party Council (N.P.C.), her statement came under direct focus. One of Moya’s attorneys, Elson Kaseke, argued that the statement was not directed at the prime minister. Kaseke explained what he meant later to reporters, after which his counterpart, Michael Young, offered his reaction.

“If the Prime Minister is out to get you and so on, she never said that. You can read and reread the transcript the transcript of your own news and you won’t find the words where she is saying “the prime minister is out to get me” or where she derogated the prime minister in any manner, way or fashion. In fact you heard affidavits in court. She said that she holds the Prime Minister in high esteem as her party leader. She agrees with his principles, his views and so on and she is a fully committed member of her party.”

“So who was the ball-less person that she was referring to?”

“She say someone—your guess is as good as mine.”

“Do you feel that through these efforts you will be able to get her back on the U.D.P. Central Party Council?”
Elson Kaseke
“Let’s look at it like this. This is one of the arguments. If she is brought before the ethics committee and she is tried and she is exonerated, I might be able to answer your question, will she be brought back to the National Party Council.”

“You can’t sue to be in a party. It is like suing to be in a marriage; once one of the groups in the contract don’t want it, what’s the use?”

“You see you have rights. You obtain legal rights, vested rights. This is a contract, the U.D.P. constitution is a contract.”

“I could not believe my ears with some of the submissions that were being made, meaning that I disagree with them fundamentally. But I feel that we put forward a good case. It’s really up to the judge to determine whether the injunctions that they have asked for will be granted. It’s really up to the judge.”

“If I am to understand the affidavit rightly, Mayor Moya’s affidavit, she said that she was not referring to the leader of the party as someone who does not have balls. Am I right?”
Michael Young
“That’s one of the reasons I was miffed. I found that to be rather remarkable because I think that the language, including questions and answers, spoke for themselves. So I found it remarkable that these interpretations were being alleged on her part.”
Justice Minet Hafiz adjourned the case for an undetermined date when arguments will continue.
