Indecent assault charges struck out, victims fails to appear in court
He was accused of attempting to sodomize a nineteen year old male last year, but tonight Albert Hendy is a free man. Hendy was charged with Aggravated Assault of an Indecent Nature, Aggravated Burglary, Wounding, and Damage to Property for the incident which occurred on October fourteenth, 2007. But when the thirty-four year old construction worker appeared in Magistrates’ Court today, his charges were struck out for Want of Prosecution because the victim did not appear in court. The teenager had reported that he was at home that Sunday night when Hendy stomped open his front door. He says the man then put a knife to his throat and ordered him to take off his pants. The victim obliged and reports that Hendy performed an indecent act before attempting to sodomize him. During the incident, a struggle ensued in which the teenager received cut wounds to his finger and damaged his flat screen television. Hendy reportedly left after the struggle.
