Government and Jeffery Prosser tangle in Miami Court
Government faces another threat of a sizeable damages award against it; this time in a U.S. District court in Miami, Florida where proceedings are currently taking place. Jeffery Prosser, who temporarily owned B.T.L., is suing the Government for substantial damages on the grounds that he was wrongfully deprived of two directorships in B.T.L., an issue that goes back to 2005.
There are many twists to this case, because while the Government tries to resist that claim in the U.S., at home, Prosser’s lawyer, and sometimes acting Attorney General, Lois Young, fights to keep Prosser’s claim and entitlement to the damages alive. B.T.L. was dissolved back in May 2007 and replaced by Telemedia but in the meantime, Prosser and his company, ICC-LLC, filed for bankruptcy in the U.S. Young, on behalf of Prosser, maintains that the dissolution of B.T.L. was unlawful. And as a consequence of that position, which has been disputed in the Courts by the Government, it is likely that Prosser’s damages claim in the U.S. can be increased.
In the face of this, it is known that Telemedia has a judgment against Prosser’s Belize Telecom, for around fourteen million dollars as a result of certain payments made when Prosser was in control of B.T.L. Earlier this month on July eighth, Telemedia sought to wind up Belize Telecom to ascertain what its assets are, but Belize Telecom, which Young also represents, resisted this in Court. Belize Telecom is also the company which owned the shares in B.T.L. through which Prosser now seeks damages in the US. Prosser’s claim for damages is even more interesting because not all the shares in B.T.L. acquired by Prosser were ever paid for.
