Telemedia and Telecom battle it out in court
The legal tangles involving Belize Telemedia continued in court this morning. Today’s case involved an application brought by Belize Telemedia that seeks to wind-up Belize Telecom and collect payment of a fourteen million dollar default judgment debt ordered by Honourable Justice John Muria last year.
Belize Telecom is the company that evolved last year when Belize Telecommunications was acquired temporarily by Jeffery Prosser.
Attorney Lois Young, for Belize Telecom Limited, argued in court that if the company is to be wound-up, it in effect would be wiped off the legal map, thereby preventing it from proceeding with a pending constitutional motion. Young also argued that the only purpose for winding up the petition is to restrain Telecom from proceeding in its constitutional motion since Telecom has no assets to cover the judgment debt. Senior Counsel, Eamon Courtenay for Telemedia, absolutely opposed the application for adjournment, arguing that nothing that a court can order in this case can refrain Telecom from proceeding in the constitutional claim since the winding up order is subject to the jurisdiction and supervision of the court. After all the technical arguments, Justice John Muria granted the adjournment until the pending constitutional matter has been determined.
