Battle over boardwalk set for December

Story PicturePrecedent over the legality a fence was set in July 2003 in the case of the Belize City Council versus Brian Brown. Authorities broke down the wall around Brown’s yard on the basis that it was higher than Council regulations allowed. But in the subsequent Supreme Court trial, Brown won his case as his attorney, Dean Barrow, successfully argued that the council had exceeded its powers when it destroyed the structure. Fast forward to December 2006 and Dean Barrow will be back in court to fight for a fence … this time one belonging to the Fort Street Tourism Village. Today, attorneys for the Government, Fred Lumor and Samira Musa Pott and Barrow appeared before Justice Troadio Gonzalez to argue over a temporary injunction against the Government. Those arguments never took place however as Lumor gave an undertaking that the Government officials would stay away from the site pending the outcome of the substantive case. And as News Five’s Janelle Chanona reports, that trial will deal with several issues.
