CCJ Hears Dangerous Harm Case Against Gilbert Henry

The Caribbean Court of Justice also heard from Director of Public Prosecutions, Cheryl Lyn Vidal.  The D.P.P. is seeking the CCJ to re-instate an oral ruling delivered on twenty-second March 2017 in the case of Gilbert Henry. Henry was found guilty of dangerous harm and sent to jail for five years in 2012. When the oral judgment was handed down, the appeal was dismissed and his conviction and sentence were affirmed.  But when the written ruling was delivered in June 2017, the court of appeal allowed the appeal and quashed the conviction.

“This is an appeal against the decision of the Court of Appeal of Belize, handed down on June 16th, 2017 allowing the respondent to appeal against his conviction of quashing his sentence.  It is brought by way of notice of appeal filed on December 4th, 2017 pursuant to special leave granted to the appellant on November 16th, 2017.  There are five grounds of appeal that have been filed by the appellant and with your honors‘ leave I propose to argue grounds two and three together and grounds four and five together, and if I may proceed by stating the ground and the facts relevant to each ground and then making my submissions in that manner.”
