Brian Herrera wins appeal of murder conviction

Murder was the case and twenty-four year old Brian Herrera was the person found guilty of the crime in May, 2007.  We say “was” because just before three this evening the Court of Appeal threw out the conviction after his attorney Hubert Elrington successfully argued that he should not have been convicted since the prosecutor failed to produce evidence of identification during the trial. Elrington submitted that although there were many witnesses, none of them could identify Herrera as the man who fatally shot forty-nine year old Eugene Encalada on October seventeenth, 2005. Herrera was accused of riding by and shooting Encalada on Dean Street. The gunman, who was wearing a mask, was pursued by police and ran into a nearby alley, abandoning his bicycle when he was almost caught. The cops saw him throw an object, which turned out to be a bag with forty rounds of point thirty-eight ammunition. While the murder conviction was quashed, Herrera will remain in prison for the Possession of Unlicensed Firearm until October of this year.

    The criminals in this society sure do have a lot of money, with all these big time lawyers pleading their cases what else do you expect.

    Why don’t these same attorneys, do some pro bono in the DPP office and by doing that we won’t have so much nolle pros. lets see if their willing to put their money where their mouth is.

    It is so sad to see guilty people walk free. The Bible did say that the wicked will prosper for a while. But never knew that it will be in my time.

    I am not judging him but he was found guilty having unlicensed firearm earlier. So, I am thinking he is no innocent. He is not new to the game of violence. Just another criminal will be free to continue the violence in our community. It is so sad.

    I am waiting to see justice prevail in my country. Hopefully it will be in my lifetime.

    I can’t believe HOW EASY IT IS TO MURDER PEOPLE AND GET AWAY WITH IT IN BELIZE….this has got to be ONE REASON WHY THE MURDERERS KILL, THEY KNOW THE POSSIBILITIES OF THEM SERVING ANY REAL TIME, ARE NONE!!!!

    it is my belief that a man is innocent until he is proven guilty by the courts and should be granted every opportunity to prove his innocence no matter the time being. Belize’s justice system should aim less at imprisoning but more at promoting justice, because the fact is that there are some innocent people that pay for the crime of others even though it would be prudent to say that society disregards that fact because they are tired of the violence ad refuse to have faith and give second chances.
