Prosecution ordered to give full disclosure of evidence against mayor

And in court today, the case against Belize City Mayor, Zenaida Moya Flowers inched one step further when a date was set for a preliminary inquiry. The prosecution presented some of the evidence against the Mayor and two of her senior finance officers but Chief Magistrate Margaret McKenzie informed that the prosecution needs to present all the evidence it has against the trio. The defense has been requesting full disclosure of the evidence since October first of 2009 when Mayor Moya Flowers along with City Administrator, Dr. Kiran Vanjani, and senior Finance officers, Kiran Bhudrani and the now deceased, Dwain Davis were charged. This morning, the parties agreed that the preliminary inquiry should start on April twentieth. Mayor Moya Flowers, Vanjani and Bhudrani face twenty-two charges of Uttering a False Document for twenty-two receipts worth seventy dollars each that allegedly came from the Esso Gas station at mile two on the Northern Highway. The defendants also face another charge of Failure to Comply with City Regulations. News Five spoke with Anthony Sylvestre, attorney for Kiran Bhudrani after the adjournment this morning.

“They were charged with indictable matters and before the matters—if the matter is sent up—before it is sent up to the Supreme Court or in the event it’s sent up to the Supreme Court there has to be a preliminary inquiry. But fourteen days before the preliminary inquiry there needs to be full disclosure of all the documents, statements, evidence, what have you, everything that the prosecution has in their possession against the defendants. That wasn’t done and the prosecutor is indicating that will be done by next week Thursday. So the matter has been adjourned until the twentieth of April, which would give all parties sufficient time to put everything in order for the holding of the preliminary inquiry on that date.”
