Witness’ memory at fault and attempted murder case falls apart

The April session of the Supreme Court got underway today. There are forty-nine cases to be heard. In the first case dealt with, two men were acquitted of Attempted Murder despite an original testimony from the victim, Jermaine Jones, a resident of Banak Street, who was stabbed sixty-eight times. Jones was short in his testimony when he took the stand even though in 2007 he gave police a clear description of his attackers, which resulted in the arrest of Francis Miller and Derrick Parham. This morning, Jones would only say that when he was stabbed by two men, the area was too dark and that he did not see the faces of his attackers and neither could he identify Miller and Parham. Prosecutor Yohhahnseh Cave asked the court to treat his witness as hostile and put to him his 2007 statement in which he gave police a vivid description of the two accused men. Judge Troadio Gonzalez then directed the jury of nine to enter a not guilty verdict against Miller and Parham and they were set free. Outside the court, Jones said that his action in court has to do with the many threats he has received, one as recent as Monday night. On the day of the stabbing, Jones had been hanging out with the two men on Curassow Street. When he left the area he was stabbed on the chest, neck and face area and almost died.

    The “witness/victim” should be sent to jail until he gets his memory back! Obstructing the Course of Justice charges should have been slapped on him immediately and he should have been placed on remand, with the DPP insisting on a retrail (In at least 6 months of him being on remand).

    Hang who? Most of them aren’t even in prison! You’ll end up hanging one or two people — that won’t do anything. Let’s talk about arresting and convicting people first. How about doing the real hard work — shaping up the police force and restructuring the judicial system. Oh, no, that’s too much, a quick hangin’ should do the trick, eh?
    You think hanging less than a handful of people who are in prison for murder right now will deter these people? No. What will deter them is knowing they will be convicted. Right now, they don’t even have that to stop them!

    lovebelize la ca, I agree with you, Barrow only know how to throw words, not how to govern a country. I agree lets see how the punks with the gun will look at the rope just before they put it around their necks. The whole legal system in Belize needs to be broken down and rebuilt. Start jailing these witness who get amnesia, lock the up with the same criminals, see how fast memory comes back.

Mr. Jones’ only prayer is to go live in one of the other neighbouring countries. Those killers are laughing, and guess what they will kill again, why?, becasue they can and they know that can beat the broken down legal system.

    Yeah I agree with J.P. how we gonna hang people if we cant even convict or say even arrest criminals? Belize just needs some real shaping up. I blame a big circle of corrupt individuals and although i dont like to get politically involved i think the P.U.P and some its supporters along have a lot of fault because they were the ones who started all the corruption and downfall of all our system. from the police, school system, our economy even healthcare. They just robbed the poor and never were convicted for all the obvious crimes they committed. Now what they want to do is try to wash their hands and point fingers. Only a fool or pretend to be fool cannot figure this out. Come on every Belizean knows who are these set of corrupt families that are helping to destroy Belize. Shame on them. I do not agree with U.D.P either because i think they seem to be ignoring the people’s concerns. Why dont they change the laws of the courts or constitution. There’s so much they can do. Im not sure why they sleeping up? Hello are u there? We cannot sleep up things are getting out of hand. But let me tell you its not only about the government what about us?

    I don’t know if you all have been paying attention or what! But you people are here criticizing Belizean society so harshly. It just shows that we are all psychologically messed up and need some serious help beyond justice through the courts. Especially Elgin, what a ….. thing to say. The DPP’s office can only work with what is given to them. They cannot make a case or a conviction out of mere hearsay you dumb f&*k!

    be realistic, imagine you being threatened to be killed, or your kids, wife, husband, mother, father killed. what would you do?

    think Belize needs to develop some sort of witness protection program. I honestly would think twice before testifying, and that’s being real.
