Darren Banks and Steven Zelaya freed of Attempted Murder charges

Another attempted murder case has fallen apart today.  As far as our records show, Darren Banks has been associated with many police related incidents as far back as the year 2000 and the charges have been from the benign to murder. Today’s latest charge was Attempted Murder for a confrontation that occurred on October twenty third, 2008. Banks, who is now thirty two, and his co-defendant, twenty five year old Steven Zelaya, were freed of two counts of Attempted Murder and became free men.

The case fell through due to want of prosecution. The prosecutor could not act against Banks and Zelaya because the victims were not willing to testify.  Because there were no victims, the prosecutor had to throw in the towel.  The case relied on the testimony of Richard Russel and Alex Myers who initially said that while on Central American Boulevard near the intersection with Banak Street, Banks allegedly drove up to them in a green Saturn and later opened fire. At the time, Myers claimed that he recognized Banks and the passenger who fired several shots at them. Russell and Myers ran away while the shots were being fired. None of the pellets hit their target and they escaped unhurt.
