His uncle died after he hit him over the head, jury says it’s not murder
In the Supreme Court, a jury this afternoon reached a verdict in the trial of a Cayo resident who had been charged with the murder of his uncle. Kenneth Garcia stood accused of murdering fifty-four year old Sergio Amilcar Garcia back in 2006. The incident occurred between eight and nine o’clock on September twenty-second at the home of Kenneth’s father in Bullet Tree Falls where Sergio also lived. Sergio was hit in the head with a piece of metal pipe. He succumbed to his injuries on the following day while undergoing treatment at the Western Regional Hospital.
In a caution statement given to the police when the incident happened, Kenneth said he killed his uncle in self defense and at trial when he took the dock, he claimed it was accident. According to Kenneth, when his uncle came towards him with a rock, he grabbed a pipe and instead of hitting his uncle on the hand, he hit him on the head. He told the court that he yelled for help since Sergio was bleeding and had to be rushed to the hospital where he died.
This afternoon, the jury of four men and eight women emerged from the deliberating room after more than four hours and concluded that Garcia was not guilty of murder but guilty of the lesser charge of manslaughter. Sentencing is set for Friday, June eighteenth before Justice Troadio Gonzalez.

so even if this story is bull we will never know the entire truth since there were no witnesses, and the jury panel occupied by idiots.
I agree with the jury on this one.
jury panel goes to court without knowing d law until the judge lay it towards them. Its not easy to sit on a jury panel, one has to be familiar with being there before saying that the jury panel does not know what they are doing.. the police Dept is the one that does not bring enough evidence to convinct one person.
I totally agree with having insignificants on the jury. Not only the juries but entire justice system are full of crap, they need wake up and step up into reality as to why criminals are still walking on our streets.
Kenneth get away this time, but believe he will kill again, cause everyone in the village knows he is a drugs user, and he knows that coacaine being his favorite, of course the dead man cannot defend himself, so whatever kenneth says goes, but its a true fact he killed his uncle,
Kenneth is very aggresive when under the influence of drugs!!!!!
It won’t be too long before he is back in jail.
You categorizing the jury as all kinds of degrading words will not make you any smarter than you currently are or are not.
Manslaughter is certainly in order in this case because there is provocation, which caused this young man to loose self control and use deadly force where it was not justified but a lesser level of force could have been perfectly justified.
Had any of the rocks being hurled by the deceased made contact with the defendants head and caused him a serious injury it would have definitely been a justifiable homicide.
Uncle or not, no one has any business going around stoning people with rocks.
We cant always blame jurors when cases fall apart. They don’t always know anything about the law and dont need to. The Police department is responsible for properly investigating and compiling the evidence of each case before handing over to the DPP. The DPP’s office is respnsible for putting the case in order and present it in a way laymen and women of the jury can understand.
There’s a serious problem with the Justice system in our country and that’s because no government ( UDP nor PUP) is willing to spend money on proper forensics especially for major crimes. WITH PROPER FORENSICS, THE DEAD DO TELL TALES!. GOB must care enough about getting criminals off the street. Forensics is cheaper, has a longer memory and is more reliable than witnesses, and lets face it, its more realistic than funding a WITNESS RELOCATION PROGRAM at this moment.
I just hope that the jury was well educated and that they were educated people as well, because lately I have been witnessed to some cases whereby some or let me say MAJORITY OF THE JURY HAD NO JOB…. just by looking at them you can see that they are lossed in this world…(non-educated people).
I do not agree with how they select jury.. this case was ok with the verdict..
Our government needs to stop play with our lives and start to face reality, because the more they f____k up, the more killing they will be because most killings happened because of what takes place in court…. thank you!!
He should never had been charged with murder unless the authorities had strong evidence of forethought. for him to be convicted of murder they would have had to show intent or motive,with the self defense claim,the jury has no choice but to call it manslaughter.sometimes when People are being charged,the authorities need to be more mindful of POINTS OF LAW rather than generalizing or escalating the charges without merit.some charges elicit an emotional response in people but when they don’t hold up in court,the public becomes outraged.We do not realize the criminal got off simply because he was not properly charged. the prosecution cannot effectively argue a case where the circumstances do not convincingly support their argument.they sometimes lose because of the overkill.keeping things in perspective would go a long ways in rebuilding the public’s trust in the legal system.
I think in this case justice was not served. Based on the facts as I know them, the defendant with no prior arrest or conviction was provoked by his uncle as he has been for years. None of this was revealed in court. Had the uncle had his way it could easily be him in court and Keneth in a box. From the outset he should have been charged for manslaughter and not murder. Instead he has been locked away for the past 3 1/2 yrs. While Kenneth has not been a model citizen which one of us are? He has been grouped/labelled as a murdering thug. This case has nothing to do with all the vicous killings occurring now a days. Kenneth is facing the consequences of manslaughter and in the mean time a lot od real murderers are walking away free because of poor police work and political interferance. Also important to know Kenneth has handicap, he only has one useful hand. How many men can defend themselves with only one hand. There is nothing wrong with the way the jury are selected, there is something wrong with the way the police handle there investingations. I would say let him get off with the lowest possible sentence. At least that would salvage some sort of justice.
I cant believe people just talk because they have a mouth!!!! based on sharing little time with the family, kenneth have been a good brother,son,uncle andgood freind.also graduated from college he has been a good working man,who in the village dont drink?????? maybe only mr macal river. I thinbk justice was not served right therefore he dint get away with any thing as some people are saying. he has been behind bars for almost 4 years.after all he was only defending him self.we have heard about other murders in the village did anyone got arrested no. I JUST HOPE AND PRAY TO GOD THAT EVERTHING THAT SHOULD HAPPEN,LET IT BE IN KENNETH FAVOR( I MEAN HE HAS DONE ENOUGH TIME IN PRISON)
well yes, justice have been served in this case…..its his uncle he killed people! reguardless if he spends the rest of his life in jail or not he will carry that guilt in his heart. I think that is enough punishment for him. dont you think so? who ever is free of sins throw the first stone……….
