AG’s office presents Us evidence in Seawell extradition
Gary Seawell, one of two brothers currently incarcerated at the Hattieville Prison on drug trafficking and weapons charges appeared before Chief Magistrate Margaret Gabb McKenzie this morning in respect of an extradition request by the US. Seawell is wanted by U.S. authorities in connection with the trafficking of cocaine and marijuana as well as money laundering dating back to the mid-nineties. Extraditing him to face those charges however is a legal battle that may reach as far as the Caribbean Court of Justice. This morning attorney Magali Perdomo presented legal bundles which outline the reasons why is acceding to Seawell’s hand over to U.S. law enforcement. His attorney Arthur Saldivar, on the other hand, is awaiting a Supreme Court ruling by Justice John Muria on Friday regarding a treaty that was previously signed between Belize and the United States.

“Today Mr. Gary Seawell was required to be in court as the AG’s ministry in the form of Crown Counsel Ms. Perdomo sought to tender the bundle that came from the United States Department of Justice upon which to form the basis of the extradition. That’s the evidence that they seek to rely on. That was done today and the matter was thereafter adjourned until the thirtieth of August where we should proceed one way or the other.”

“You had mentioned a while ago that this, to some degree, is contingent upon a ruling by Justice Muria. Can you speak to us a bit on that as well?”

“Well yes. What happened is that under our present extradition act, the act makes an allusion to treaty signed between Belize and the United States in March of the year 2000. And Section nine of our extradition act makes particular reference to that treaty and expressly provides that as it relates to persons being extradited to the U.S., that that treaty supersedes any other law within Belize pertaining to extradition. So the treaty takes precedence over it. By virtue of that, Isani, the Supreme Court is being asked to basically determine whether or not since the law so expressly provides in that instance that only that treaty is to be looked at as it relates to the extradition of Belizeans to the United States, whether or not the AG Ministry or the U.S. Embassy or whoever is seeking to have Mr. Seawell be extradited to the U.S. can rely on any other provision within the act to do so.”
The ruling by Justice Muria on Friday will determine whether or not they will make an appeal to the Caribbean Court of Justice.The U.S. Justice Department is also seeking Mark Seawell for extradition on similar charges.



If he did not set foot in the USA, he should not be extradited. America does not own the world…… any more.

Send them packing to face our kind of justice here in america . they think that when the do their mischief over here belize is a safe haven, they know a place call home. most of the crime happening in belize are people who are deported back and then you have the copy cat illiterate belizeans who don’t want to work and whose parents cannot afford school follow these mischief. America does not send any of their citizens to other countries to be tried. If he did not commit any crimes in the US how can they asked that he be sent for trial to the US?
Legal minds in Belize let me share something with you! If he is ent to the US to be tried and surely serve time he will be returned better trained to Belize and better prepared to commit bigger crimes in Belize.
America should try harder to reduce to consumption of drugs in the US which will reduce the demand and consequently the need for so much drugs and eventually if there is not much money to be earned all the negative stuff that comes with drug use will reduce.

All we know about the Sewell boys’ wrong doings in America is what the Americans are saying that they did. Alright… my thing is that if you do the crime, then just buckle down and do the time. Now, what about the Americans that he allegedly exported the drugs to in the States? Are they also locked up and looking at long prison sentences?? Until somebody convinces me to the contrary, I have my reservations about extradition.
