New trial for man who is accused of killing his brother-of-law

Linsbert Bahadur was charged after the April 2006 murder of his brother-in-law, Albert Wade, who was killed by a single bullet to the face in the Cayo District. His trial started on August twenty-third and concluded today at the Belmopan Supreme Court with a nolle prosequi. The main witness, who drove Bahadur to the scene, gave vivid detail of the shooting. Samuel Neal Junior, testified that he took Bahadur in his taxi to Nigroman Road, which leads to Chaa Creek in the Cayo District. He says Bahadur left the vehicle and went further down the road where another vehicle approached. Neal could not see who was in the other vehicle, but he says Bahadur spoke to the driver briefly and then he heard a single gunshot. According to Neal, the accused man got back into his taxi and asked to be taken to Santa Elena. Wade was found the following day slumped over the steering wheel of his vehicle. Seven other witnesses were called but the case fell apart when Doctor Mario Estradabran could not be located because he is out of the country. The case was dismissed but Bahadur was only teased with the idea of freedom because Senior Crown Counsel Cecil Ramirez made a submission to have him rearrested and the court upheld it. Bahadur will be again be read his indictment for Wade’s Murder next Monday and a retrial will begin as soon as Estradabran returns.

    Did Dr. Estradaban ignore the subpoena to appear? Isn’t there a written report that he submitted to DPP who advised the BPD of the charge(s). When they knew that the doctor would not be available to testify, why didn’t the prosecution ask for a continuance instead of a retrial?. 4-1/2 years to get a resolution on a case with the accused in custody & willing witnesses is uncalled for/

    The court need to keep Mario passport locked up in drawer, either he cannot make it to a crime scene or he is out of the country. The dead will just have to be buried quick until mario returns back to belize.

    How can a case fall apart because Dr Estradaban isn’t there? All he would’ve done was take the stand to say death was caused by a gunshot wound to the head which caused severe trauma (obviously).
    Good thinking on the part of the lawyer for moving to have him re-arrested. The court system continuously fails the belizean people. How can the country grow when it’s being repressed from within.

    i think it’s the duty of the gov. to appoint a doctor in every district instead of depending only on Dr. Mario E. so investigation would be more faster than to wait till he is free from other work he has. maybe he’s on vacation which is a norm for every worker but then we’re left with none to do the work. this is really a shame that our jewel only has one doctor of such work profession.

    why couldn’t DPP plan ahead and find out about the doctor’s availbility before starting the trial? Seems like a waste of time and money due to negligence in the DPP. Why do we still lack professional training there as well as in the police?

    I do agree with all of the above comments, once again another man would have walk out of court a freeman……..after killing! We need justice, we need our system to be more aggressive the Government of Belize need to protect his people……..We the Belizeans are crying out for justice, another man almost walkout of court to go kill again, how sad!

    What a shame in the entire Country of Belize there is only one forensic pathologist.Every district in Belize should have a pathologist.

    Should Mario Estrada die who’s going to do the autopsy on him?Instead of worrying about who the new leader of the opposition is going to be,GoB need to start investing some money on some of our students by sending them abroad to specialize in this field.

    I think this post mortem …. dah waste of time and money, and still nothing come out of it, anybody can tell you he man got shot, his brain bust up and he died, on the spot, so why can’t the hearing go on with out estradabran, madas I am sure he has a written report than can be taken in consideration while he is absent from work,
    The man died, now the justice is saying hang dis one …..Done, finish!!1

    i guess the doctor doesn’t know how to write, duh isn’t there an autopsy. come on people common sense that’s all u need.
