Retrial ordered for man accused of rape

Back on July twenty-first, on the day of his fifty-second birthday, Romero Jimenez was convicted of one count of carnal knowledge for having sex with a fourteen year old girl.  For the crime he was sentenced to seventeen years but today that sentence was set aside and a retrial was ordered by the Judges of the Court of Appeal. His attorney, Simeon Sampson, successfully argued that the trial judge failed to instruct the jury in respect of testimony by character witnesses on behalf of Jimenez. Sampson urged the judges to squash his conviction and set aside the sentence. The judges agreed with Sampson but only to a certain degree but ordered a retrial. Jimenez was offered bail in the sum of ten thousand but was remanded into custody at the Hattieville Prison when he was unable to meet bail. In July 2008, a fourteen year old girl of San Joaquin Village accused Jimenez of raping her when she exited her bathroom at home. She was alone and the alleged incident was not reported until two months later on September twelfth 2008 when the child’s mother found out and took her to the Corozal Police Station. On July twenty-first of this year, in the Northern Session of the Supreme Court in Orange Walk before Justice Michelle Arana, Jimenez was found guilty of carnal knowledge and sentenced to seventeen years. No date was set for the retrial.

    Why doesn’t the assembly or the judges enact a set of standard jury instructions? Then there would be no such mistakes, because all judges would read the same instructions in every case, and we would avoid wasting money with retrials. Our legal system is too much a game, and not based on common-sense or truth at all.

    The media need to call out the incompetent judge too. They are being paid big money to do a job. We finally get a conviction and Sampson and the other bunch of idiots of a lawyers will find a loophole to get these criminals back into society. I know its their job, but their turn will come and they will hold thier heads in disbelief when it hits home one day. Criminals have to be held accountable for their behavior or they will continue to do what they do….knowing that the justice system has flaws and these “unethical” lawyers will get them off.

    I know this case and all the people involved personally and there are a lot more issues involved in this case that what appears on the surface. Actually, there is a high possibility that this child was not even raped by this man. If he did it i definitely agree he should rot in jail but this case needs to be looker at very carefully before we make judgments and want to castrate people.

    Sabrina if it was your daughter or family member would you feel the same? For the childs sake I hope it did not happen, but who knows.
