Shots fired as la Cabana owner’s home raided by police

A team from the Gang Suppression Unit carried out a surprise raid at the house of Mike Menjivar, the well known owner of La Cabana Bar in Belmopan looking for illegal items. It started before dawn and continued all day. A shoot-out ensued, Menjivar and his wife were held inside their house, but their three children were removed from the premises. Menjivar returned to Belize from Guatemala on Thursday following a round of surgery; he is said to have been seriously injured in the raid. At about six this evening he was taken to the police station and we’ll have more on that, but When News Five’s Andrea Polanco arrived at the scene, a G.S.U. team was guarding the main entrance to the community of Las Flores, while the others surrounded Menjivar’s home as well as La Cabana.

Residents of Las Flores say they heard a wild spray of bullets in the area sometime around four thirty this morning, a little over two hours after La Cabana closed off for business. Commander of the G.S.U., Marco Vidal, told us that they were acting upon a tip to search Menjivar’s residence but they were greeted with bullets:

“Immediately thereafter, shots were fired from inside the house towards the officers. Immediately our Officers took cover and the shots despite repeatedly after and even after the shots were fired the police continue to say that it is the police and the shots continue to come into their direction and they didn’t responded. I must say that the unit exercised a lot of restraint most of the gunfire was suppression because we were aware that a lot of other occupants that included minors were inside the house so for that reason there was a lot of suppression fire, this was not the case eventually the house was breached umm the person were barricaded inside the house and this was when I arrive and I spoke to the occupant to surrender himself umm he was inside one of the rooms I suppose it was the Master Bedroom, and eventually he was subdued and umm  he had a firearm at the time in his hand when he was apprehended and we immediately called the ‘scenes of crime’ although umm right next to where he was there appears to be another firearm in a bag that wasn’t tampered.”

Is it possible that Mike Menjivar suspected that robbers were entering his home? Not so, says Vidal, because the G.S.U. had to get over the gate to gain access to the property:

“Breaching the fence would not have alerted anyone inside the house. Our officers are trained to operate in stealth mode, breaching that fence would not have given, and they don’t have cameras to say they saw us and therefore they reacted to that. Once they were at the door they informed the occupants there was a warrant and they were about to execute the warrant. There was no need for the persons inside to respond with gunfire.”

But a security guard at the night club says he witnessed it all:

“All the vehicles and motorcycles were coming that way, they surround the whole house, they were jumping the fence and when they couldn’t go up they started shooting. They killed all the dogs they were about fifteen dogs in the yard. The opened the burglars door on the fence with gun shots. They started shooting around the house they broke up the glasses. The broke down the door, they shot the door until they broke it down. Some of the bullets came and they caught the trucks, they caught the wall and the glass in the business and even the neighbors’ vehicle door over there has bullet holes on the side and the house next door.”

While some Las Flores residents claim that bullets were flying carelessly, Vidal says they weren’t from the G.S.U.’s guns:

“The shots that were fired to the officers are from the inside of the building. There are actually impacts on the establishment which is a clear indication that it came from inside the house. The holes from inside the house will certainly point to that direction so the indiscriminate firing was from inside the house. The Gang Suppression is trained in operating these firearms and they will not randomly shoot if they cannot see their target so it’s not like the police officers were in anyway indiscriminately firing gunshots.”

 

Menjivar’s relative says that he doesn’t believe the G.S.U. should’ve carried out the search in that manner:

“I’ve heard they had a tip, acting upon information supposedly about drugs or firearm I know the law makes provision for this kind of thing to happen but there is a legal process for doing stuff. I know if they have a search warrant it’s a legal process and they should do it but I really have a problem with the way they supposedly carried out their job today. When the shooting started the guard called Mike’s brother and one our cousins and they came to inquire, and upon coming to inquire they were captured also and they were thrown to guns and gun put  on them and stuff, they’re still out there.”

“Would you happen to know if Mike or somebody close to him open fire on the G.S.U. this morning?”

“I am not certain  as I told you I haven’t heard official information but umm I put myself in his shoes if I am asleep and people start firing in my house and I have a gun maybe I’ll respond back as a reflex.”

 

The G.S.U. says that charges are expected to be brought against Miguel Menjivar:

“Our officers’ lives were threatened because there was gunfire close to their face and also the Gang Suppression Unit vehicle received impacts from gun shots. The tire has exploded the rear of the pickup truck received impacts as well. He will be facing charges for aggravated assault upon the officers; he will also be charged for attempt murder and damage to property upon the vehicle.”

The GSU have no respect for human life and I have no doubt that they indeed went there with unnecessary force shooting those dogs to enter the property, anybody would do the same if they are in bed and some ANIMALS violated their home, murdering their dogs. What the hell is wrong with these people? That house today, maybe our house tomorrow, seems that anybody can call in “tipping” off the police, even if out of hatred and jealously and they will come and do this to them….INSANITY

    Pretty sure they did, but I would have liked to hear ASP Vidal say that the Police used a megaphone, and did so for a good 20 miniutes before taking aggressive action. Without the official alert using the megaphone, a savvy businessman like Mr. Menjivar would likely think it is a concerted attempt by some very bad people to do him and his family harm. A naked shouting voice is merely 88 decibels, and that doesn’t take into account crosswind. Mr. Vidal, say that you used a megaphone. After that I’m good with the rest.

    The News said that it was a surprise raid.Then how else would we expect the owner of the house to react with the current crime situation?Honestly i really don’t know of any raid that wouldn’t be a surprise.The cops wouldn’t normaly inform anyone that a raid was imminent unless it was a case where the cops had been bribed .

    Well all this talk about nothing let’s hear about what the GSU searched the house for, did they find any illegal firearms or drugs was that not what they went to search for, and also if about 15 dogs were killed in the yard I would think that this is before they even reached the door that surely would have alarmed the occupants of the home, let’s hope that this raid was not all about nothing, this could have been my home that some devious neighbor reported on for no valid reason. Remember, My Legacy B 4 My People.

    Supressive fire is a very useful tactic in WAR situations. It certainly does not belong in our neighborhoods because supressive fire is exactly that, shooting without actually shooting the threat or target from which the shots are coming therefore HAVING WILD SHOTS GOING ALL OVER THE PLACE.

    The GSU has a job to do BUT THEY MESSED UP THIS ONE BIG TIME. They certainly appear to me as cowards hiding behind their masks playing tough but the second shots starting flying in their direction they did not know what to do and hence why they started fireing wildly.

    SUPRESSIVE FIRE does not belong in our neighborhoods PERIOD.

    If I am asleep and I hear somebody storming through my door, my reaction would be the same as this guy did; knowing the increase in robbery and crime.
    Yeah, the police may have stated that they have a warrant to search the building, but did they ensure that the occupants were fully aware of their intentions. I say this because most of the police here in Belize abuse their power 90% of the time, and I strongly believe that is what happened here. They rushed into the raid with out conducting preliminary measures and since they are the law this poor guy would most likely be blamed for their incompetence. I mean why would I as a father and a successful business man, or any innocent person for that matter greet the law with a hail of bullets? The answer is, its because they pose a treat to you and your family so you have to protect that. The reason why they posed that treat is because they failed to carry out their duties properly!!!!!!! And did they find anything illegal?? Most probably NOTHING!!!!

    The belize police department is a disgrace to our nation. their were three children inside that home and they just show up shooting like crazies all over the neighborbood. mr. menjivar was in all rights protecting his family. regardless of how a raid operation should be run their are rules and ways to deal with these things and unfortunately the so called GSU has no clue on how to do this. doug sign is an @#$%^&* believing that he could just step in and change the crimes of this country with some many corrupt police officers how is he to do that. and honestly watever GSU stands for ito me is a whole bunch of S@#$. and since they did not find what supposedly they were tipped off about they are gonna make up all kinds of things to put on him. i would sue every single one of them

    My family has been through a lot and is still going. There was nothing to be found, therefore, the end result of this operation was NADA!!!

    The family house has been completely destroyed and I know God took care of the kids since after seeing the amount of bullet holes all over the house, I still can’t comprehend how anyone could have survived.

    The kids are traumatized as they lived/saw the terror that happened. Mike’s 11 year old son was shot at as he ran out of the room and by the grace of God was not hit. And they witnessed the abuse their dad received for protecting them.

    They GSU unit were all in civilian looking vehicles with no police tags nor sirens. How can someone who has just gone to bed know if they are being robbed? Iliana is said to have even called 911 to report that they were being robbed and pleaded for police to assist.

    Mike, Iliana and the maid are spending the weekend at the police station and we have received word that they will be charged.

    We have took a full video of the house as the GSU left and will be posting it on youtube on Monday as I get it from source and post a link here.

    Lastly, we wish the public to know that while insided the house, GSU helped themselves with softdrinks, bisquits and even the kids cereal….this really hurts….and on top they used of the phone credit of my family members and laughed while on their calls.

If the police are operating in “Stealth mode” how the hell is someone going to know its the police if you are in “stealth mode”… dumb$$He had no cameras to see outside and yelling “this is the police”: is the oldest criminal trick in the book… dumb@$$!!! GSU dressed all in black coming in at 4 am jumping over fences and shooting dogs what else is the guy going to think?? Dumb@$$!!!     i saw everything from outside the house!from the start to finish! we thought kids,babysitter and the couple were dead because we asked for information all morning and the G S U would only laugh in our faces as we asked to know at least nif anybody survived! it was a friday of horror for all the community here,seeing from the distance that dogs were dead and listening to all that crazy shooting all over the place.only GOD with his power saved the family,the house has at least three hundred shots!!!!!!!!!!mike had only his licenced firearm,which with no doubt i believe he tried to save his three kids!nothing else was found in the house,!!!that had the g s u mad all day,as we overheard almost everything they were saying,its so sad to see the way they acted at these situation,taking advantage of their authority treating us worst than thrash.

    I know that GSU have a tough job to do. We have been crying murder for so long and GSU is feeling the pressure to deliver. There are some criminal tugs that need not be I.D.. They are notorious and operate in cahoot with family members. In order to be respected and feared by these gangs, GSU has to use a certain amount of power to get the job done. Therefore, let us not throw this unit under the bus so fast. Having said all these, I recommend to Mr. Vidal to look before leaping when dealing with individuals who have no criminal records. For example, is the informant trust worthy?. The informant may be trust worthy but is the information correct?. Sometimes a little more intelligence gathering is necessary. When is the best time to act?. Night-time, pre-dawn or broad daylight?. The timming depends on the circumstance. How much force is enough?. I surely do not want the police come firing their weapons in my vicinity. What is the risk of collateral damage? . We want to get rid of the criminals not of innocent civilians. All I am trying to say is that each operation is unique and it demands good strategy and tactics on a one to one basis. I do not know Mike and have no idea if he is indeed a criminal. All the information provided up to now, suggest he is not, therefore, he has my sympathy and to Mr. Vidal, keep the good work but please be more careful and in the name of justice, if the allegations that led to the raid were misleading, them drop all charges against Mike because he has the CONSTITUTIONAL RIGHT to defend himself, his property and his loved ones.

    First of all, because you are a business man does not make you an Angel. The average street criminals are broke and cannot afford the guns they slay others with, the business men supply the money to buy big guns. Cops will not give you time to get rid of evidence during a raid. Might as well announce it on channel 5 news a day before they start the raid. Justifying people shooting at cops will not bring peace in the country, every resident will think they can shoot at the cops from inside their Homes.
    You see the result of people shooting at cops every so often in the USA on TV. He is lucky to be alive.

    I would first of all call on the authorities (courts / judges / others) who irresponsibly sign the search warrant.. I would suggest, before they sign any search warrant for those inconvenient or risky early hours or late night hours, they must verify, if the person have any prior conviction / police record of fire arm or drug related crime. Otherwise the search must be conducted between 08:00 to 17:00 hrs time frame to avoid confusion.

    Over all the incident was very disappointing for any law abiding citizen…

    We are calling on business owners to partake in a complete business shutdown on Tuesday in solidarity with what happened to Miguel Mejivar, Iliana and their maid. Furthermore, asking that people show support on court date on Tuesday as such modus operandi from law enforcement agencies should not be tolerated!

    So they were acting on information that this person was involve in illegal activities. Did they think about setting up a sting to prove that he was indeed invole in such illegal activities? If he was involve in the sale of drugs, or any other illegal activities he must engage with others, so the policeshould do proper under operation to make sure that this person is indeed carrying illegal activities. but to be acting only on a tip without proof and get search warrant to invade someone primises, is stupid and reckless. If this is how easy its is to get search warrant to invade people’s property, then for sure this will get worst, and somebody is going to get kill in the process.

    What we see here is a society that is stressed out, with high flash point. Limited oppertunities, and people are doing things to survive that they may not do under better situation. The citizens are looking to the political leadership to fix the problems, but the politicians are impotent; so they make laws, and they hire hit men who want a job to meet their econoimic demands, and they swore to carry out thier boss’s command. They think that they are making their boss look good, because its obvious that the citizens are ready to explode as a result of the high crime rate, and are demanding that the government do something to get it under control, but it will only get worst if the government does not create more oconomic oppertunities.

    Let me address Adrian Chocon, who said that if cops did that in the USA they would go straight to proson, I wonder if he really live in the United States? So many of this kind of behavour has taken place in the USA it become common opperation. The man was shot in his bed due to the fact that he wore a silver bracelett, and when he raise his hands from been out of sleep, the excuse from the cop, was that they mist took it for a gun and shot him. So shut up Chocon. Tell that foolishness to someone who does not pay attention to what is going on in society.

    From a distance I see the same kind of RAMBO attitude in the nature of Belize’s law enforcement. Seem to be getting to be the Police state to rule by instilling fear in the citizens, just because of incompetent politicians who causes hopelesness and dispear. These police officers should be a shame of themselves to like this in a little country like Belize where everybody know each other, if not directly, but indirectly through relatives and associates. Now you Belizeans know who you are dealing with, what are you going to use this experience to do for you in chosing your next political leaders?

    This man is a businessman and owns a bar so his movements are not hard to figure out. The “professionals” knew there were CHILDREN in there, so they should have waited for him to come home after work, stopped him quickly and quietly just outside his house and walked him in the front door and executed thier search…then they wouldn’d have to jump fences, kill dogs bust down doors or worry about him flushing stuff down toilets..and all of this gunplay could have been avoided.

    And yes I do know what I am talking about because thats the way a professional, well trained Police department would have done it after conducting a proper investigation, backed up with surveillance and /or undercover ops and evidence and getting a proper search warrant.

    Instead it was conducted by a lazy, trigger happy unit who’s media attention has gone to thier heads. No more short cuts guys, Do your job properly.

    An innocent child’s life is not worth it, no matter how many drugs they “may” have found.
    There is always tomorrow.

    In response to bmpresident. I think I know exactly who you are and I wonder if you hane any proof of the acccusation you are making. Because people like you are the one’s that give the rest of belizeans a very bad name. Nothing justifies this kins of Hollywood action. What does Vidal have in his so called head, if anything? It hurts me to see what this people are doing to my Country. this has the disturbing hallmarks of the beginings of a police state.     Thank you Common Sense & Belizean. I have read several versions of this story & I believe the GSU did it’s job the way they were trained to do it. They are not there to escort nice little old ladies down the church steps.

    @Adrian Chacon, I have spent most of my life in the US & I am a News junkie; years ago, police officers in Stanton, California shot a 5 year old who was trying to hide from them after they kicked the door in, they were never prosecuted, Eula Love was shot to death after an Officer said she held up a knife, it is still unclear whether or not she actually charged at him, no one went to jail, recently, a 26 tear old was killed when a Tucson Arizona SWAT team entered home, he too had recently come home from work & was sound asleep. I don’t expect anything to come from that one either. Years ago when the police blinked & did not want to use Gestapo tactics to harass a neighbor who clearly needed it, he had his toilets & every faucet on full blast as the Officers pounded on his door, they did not get him but fate did, his toddler OD’d on cocaine,

    We can sit here & scream bloody murder but understand that many criminals wear a facade of normalcy. All of us imagine how we would feel if those were our children whose lives are in jeopardy, what we also must remember is that most of us live our entire lives never knowing what Piss house smells like, without run ins with the police & never knowing what handcuffs feel like. If Menjivar was involved in criminal activity, he is responsible for placing his children at risk. How dare he fire at the Police & complain when they fired back because the poor babies were in jeopardy. I ran a business for years & often came home at night with cash. I had two great watch dogs, their bark was my alarm & sometimes an annoyance to my neighbors. Most residential communities in developed countries place restrictions on the amount of pets & what kinds we can keep in our homes based on location & the size of the property & perceived threats & health risks. If there are 15 dogs on the property & he is not running a kennel, that is a red flag & an annoyance to his neighbors. 15 dogs are there to slow the police or any potential raider long enough to flush the drugs. Even if most of us were financially able we do not want 15 children & they can be potty trained & grow up, imagine picking up waste from all those animals & the smell & ask yourselves if you really believed those were pets.

    My final point, for the people old enough to remember the L.A. riot in 1992 right after the Rodney King verdict. The Police Chief who was accurately described as a donkey & often worse, chose to pull back his force rather than be accused of being heavy handed. Actually, it was a pissing contest, he was simply showing the rest of the country what a world without those awful Policemen would be & it was not pretty. Before we stand behind these people, shut down stores & stand around with pickets, look at your own lives & ask yourself if the Police showed up banging on your door in the middle of the night or before dawn what you would do? If you have nothing to hide, open the GD door.

    mien its absolutely heart aching to hear all these chacons talkin like they dont kno wat mike is into. his crooked @$$ probably thought that the zetas were coming after him since he is a drug dealer. the gang suppression unit has done much more raids than these and this is the first of such incidents. large scale dealers like gilbert franklin, james swan and andrew papa brown all of whom had license firearms i mite add and this wasnt the case. the police officers were already over the fence and at the front door when they made it known in a very audible voice that its the police and they were in possession of a firearm. this paranoid @$$ drug dealer started to fire and that was when the police officers took cover and continued notifying him that it was the police. at that point in time no police responded. it was when an attempt was made by the other officers who were out on the perimeter to climb the fence that was when this drug pusher began firing at the police who were siiting ducks perched on top of the fence. that was when the fire ensued. thankfully no one was injured and trust me Menijars maid had sufficient time to flush down the cocaine as she did. belmopan is being taken over my el salvadorian immigrants who have no loyalty to belize. but if it is that u guys want to support a drug dealer then go ahead. its up to us belize to save our country!!!!!!!

    and for the record dude was taken to the hospital before he was takn to the police station n was veiwed by the doctor n released thereafter.

    im a police officer and if this dude succeeds in court by saying that he didnt know it was the police despite being notified trust me i will take off this uniform and so will many others because most definately this will set precedence.
    the job is already a hard one that gives u perks such as enemies for doing ur job and if an enemy with a legal firearm shoots me out of “ignorance” trust me this crappy training i was afforded will be utilized to eliminate his @$$.
