Cabana owner phones from prison walls

It is five days since the property of La Cabana owner, Mike Menjivar, in Las Flores, Belmopan was raided by the Gang Suppression Unit. Menjivar, his pregnant wife, their children and maid were all in the house when the G.S.U. carried out the pre-dawn attack. The G.S.U. head, Marco Vidal, gave his account of the operation, which was based on a tip. Since then images have surfaced of how the raid was conducted and the damage cause by the shootout that ensued. Over a hundred bullets were reportedly fired throughout the building, including the children’s room and Menjivar was badly beaten. On Tuesday, he, his wife and maid were charged with a slew of offences and put behind bars. Today, News Five’s Isani Cayetano spoke one on one with the couple who shared a gripping and emotional account of the raid.

Popular nightclub owner Miguel Menjivar, also known as Mike, as well as his pregnant common-law wife Iliana Chacon and their babysitter Rumilda Perez remain in lockdown at the Central Prison tonight where they are on remand following a slew of charges stemming from an early morning raid on his premises near the outskirts of Belmopan last Friday.  At dawn a team of G.S.U. officers led by Assistant Superintendent Marco Vidal descended upon Menjivar’s home in search of drugs and ammunition.  The unit’s cloak-and-dagger approach however, ultimately led to an exchange of heavy gunfire damaging the property extensively.

News Five spoke by phone with Menjivar and Chacon this afternoon and they recounted the harrowing experience from behind prison walls.

“When I woke up, we closed the club like two o’clock that Saturday night. When the situation, when we get to know what was happening in the house, actually it wasn’t the noise that they were doing, it was a phone call that we get from the watchmen of La Cabana—he told us that something was happening in our house—that we have to see what’s happening. When I wake up, my wife wake me up because she took the call then all I hear was that the main door of my house was getting knocked down—was getting kicked and knocked down. So I run and went to see what was happening. Then I went to shoot through the door. When I heard that the door was almost dropping, I shoot like three shots  through the door, then I run back to my room and try to see who or what was happening outside. I opened a window and I watch outside and all I see was a truck with no police letter—no kinda letters—it was a grey or a metallic color looking truck. Then we call to the station that please send help to our house cause we’re getting assaulted, or killers—we didn’t have an idea of what was happening. I have never heard that in my life yet, I wasn’t expecting this experience. And then the lady said that the police is on the way.”

Despite having called Belmopan police for help, unbeknownst to Menjivar his home was being assaulted by another branch of the police department.

“After this, I get shots all over my house, all around my house. I heard my kids crying in the room and I get desperate. I run back to my room to protect my wife and my other daughter. And they shoot all over my house—I don’t know how many shots; maybe over a hundred—through all my doors. So then we called to the station again to please hurry up cause these guys are already almost inside. The lady said that the police is almost there, to please hold on. I was trying to hold on until the help get from the police station. Now the third or fourth time that we called to the station was for the reason that these guys were already inside my house and I cannot see them because I don’t have a window like from my room to the walkway—to the area inside my house. And they were now knocking off the door of my room. When they were knocking off the door of my room, we moved to the restroom and we called to the lady because when they were knocking off the door to my room all of them were shouting police, police, police. We get desperate. We called back to the station and we tell he lady Miss, they’re saying they are police. The lady say no, no, no, no, all the police I know where all my police are and most fo the police are here only the patrol unit that went to help your house. Please noh open, wait for the police to reach to your house and help you.”

The G.S.U. officers eventually entered Menjivar’s home and proceeded to breach his bathroom door where he and his family had taken refuge.

“They were shooting all over and if I don’t open, they would knock off the door of my restroom too and they were going to kill me, my daughter and my wife. So when they were saying they were police, I couldn’t identify it, but I give up—first I give them my gun. I opened the door to the restroom and I give my gun, then I give myself to get arrested without resisting arrest. They handcuffed me the hardest that they can. Then they start to kick my face until they break my jaw and broke my nose too and a pool of blood was created on the floor. I don’t know if you guys get any image like this. And they kicked me there in that pool of blood for four hours. I wasn’t even able to breathe in that pool of blood.”

His wife Iliana, who recently completed her first trimester of pregnancy, is also on remand on nine counts as a result of the confrontation.

“My biggest concern is my kids. You know, we are locked inside and my kids are traumatized and we can’t even take care of them because I’m being charged as Mike said with the same charges which is very ridiculous. So to you and everybody, my babysitter is being charged with the same charges. He was the only one with a gun. I have my gun, we have gun licenses, I didn’t use my gun. So my biggest concern right now is my kids and I am thankful that they are alive because seriously with all the gunshots that I heard, I seriously thought they were dead because I was handling my little girl. She is ten years old, she has brain problems and she has to sleep with us. So I had to protect her. I put her in one of the only rooms that do not have low windows. If they had low windows, we would be dead by now.”

The obvious question since the incident last Friday has been whether the Gang Suppression Unit used excessive force in storming Menjivar’s property.  It is yet to be established however, which of the two parties opened fire first.  Freelance Journalist Rhenae Nunez, who also works with Menjivar’s attorney, Arthur Saldivar, has weighed in her opinion.

“The account that Mr. Vidal gave for his actions along with the Gang Suppression Unit, I’m sorry but I don’t buy it. The evidence does not support his account of what happened.  It begs the question now: Since Mister Menjivar has been charged with attempted murder and damage to property and all of that, what are the charges being levied for the attempted on his life, that of his children and his wife? It begs that question of the state.”

The couple’s lawyer, Arthur Saldivar, has applied for an early bail hearing. The Menjivars and Rumilda Perez face nine counts each of attempt murder and aggravated assault while Mike faces an additional count for damage to property.

    If a person attacks you and you feel that your life is in danger, you have the right to use the necessary force to neutralize said danger. The amount of force is in relation to the percieved threat. However, keep in mind that you will have to explain the amount of force used and why you felt your life was in danger but, once said danger has been neutralized anymore use of force is considered by law, excessive. Let us for a moment forget Mike version and let use GSU version as an example. Mike was firing upon GSU. Clearly the lives of GSU members were in danger and they were in their right to use the necessary force ( return fire) to neutralize said danger. GSU manages to get access into the house and Mike hands over his weapon, surrenders and is handcuffed. At this point, said danger has been neutralized and the lives of GSU members are no more in danger. The punishment to which he was subjected after was uncalled for and unnecessary and is clearly an example of unwarranted use of EXCESSIVE force. The use of the family house phone by members of GSU without permission is also a clear abuse. The use of someone else’s property without permission is STEALING. The innappropiate comments made by GSU members in the presence of the children can be considered as CHILD ABUSE. All these abuses are condemned by the UN, OAS and all civilized society. These actions on the part of GSU clearly shows lack of leadership. A commander should be of such character that is able to control, inspire respect, loyalty and obedience from his troops. Apparently GSU lacks such a commander. It shows that GSU is more of a gang than a professional law-enforcer unit. It also shows that the rules of engagement are not clear or perhaps ignored.

    At some point someone will tell the truth, every story to date has been self serving & conflicting even by the people who are supposed to be on the same side. No matter how much stealth these officers used, I find it hard to believe that they could keep 15 dogs quiet but I do believe the watch man called as soon as the truck pulled up & I will take a second look at his comments which I believe were in Spanish(on another source) because what he said could answer some of our questions. If the Police were fired on after announcing themselves, then the attempted murder charges are justified. Demanding that the Government or Officers be charged is a smoke screen.

    Iliana, you’re in a tough spot but you appear to have family support, your children have people to care for them in your absence. Just keep in mind that most women who end up in jail or prison end up there because of their association with men of unsavory character, I wish you well.

    It sounds like this man and his family are going to do some time.From reading this story it seems to me that someone in the Higher echelon of the Police Dept has something personal against this man.He’s probably not the type that entertain the cops with drinks when they go to his establishment.

    This out rightly wrong, the so called ASP Marco Vidal needs to be removed immediately. That is brutallity. The head of the Police department needs to pay all the damages caused to this family. This type of assault by Police needs to be done on all gang leaders of Belize City that are killing innocent people. The Police Department knows exactly who all these crimminals are but they just dont do anything, why? Maybe because they are being paid off not do arrest them. I am disappointment they way this operation was carried out. Operations are not carried this way……………………………………………………………………..

    This sounds so horrible…The police involved really needs to be reprimanded and punished….sounds like they went to this house with the intention of killing any or all the people in the house….They should all be behind bars with the same people they put in jail…My support is with Mr. Menjivar and his family…Just supposed they had killed the children, and the other adults, would they have called this justifiable actions????

    look like what was previously said is correct….BMP police are all on payroll from cabana and so GSU acted without their knowledge. if i was attacked in my house like that, i would probably “try” to respond in that manner….but..alas, I have NO GUN to respond in that manner. Baan and grow belizean and i cannot get a gun license, but foreigners can cum her, and get betta documents than us and even get to carry guns….legally….WTF.     Sounds like torture in Iraq or the like? If a man is appropriately subdued or whatever, why should he be beaten while handcuffed? Law enforcement officers’ job are not to inflict punishment on one suspected of a crime, supposedly alleged criminals are not guilty until proven so? Why a beaten? When raindrops was arrested he was not subjected to a beaten? furthermore certain evidence was found in his home but still no punishment inflicted, on the contrary he was rewarded with bail and special appearance of the dpp. Clearly, this appears to be gestapo tactics? suspension/suppression of one’s constitutional rights? justice udp style? Wake up Belizeans! Imagine the possibilities? What else is new Belize?

He and his goons assaulted the Menjivars and caused a lot of destruction both on their home and on the psychological wellbeing of the children —my God!!! What kind of Country am I living in.

    When do the people of Belize SHOW that we have had enough and take to the streets and MARCH and let the message go out that we will no longer tolerate the abuses that are being perpetrated upon us!!! I don’t wish for a repeat of August of 2005 – I hope that we can do this as the mature and descent citizens that we are. I know we are!!!

    Barrow and his crowd need to know that we are “sophisticated enough to conceptualize certain things”.

    a house was raided similarly in Belize City, weed and firearms and cash was found, only one person was charged for the firearm and all were given bail within 48 hours. the magistrate claimed that prison was too harsh for a diabetic. these people should not be in jail. I think international human rights organizations should be alerted of this serious travesty. I supported the idea of a GSU but wrong is wrong

    Ever since I saw this news being aired I have read a lot of comments defending Menjivar and condemning the Belize Police Department. Let me say now that he who defends Menjivar is because they don’t know his true character or they are associates with him. I personally know Menjivar and am not asking you, am telling you, that he is a person who has no respect for the Police or any other lawful authority. I stand along side with Mr. Vidal and like how he certainly said, no apologies to Menjivar. It was about time that a real Police Officer put you on check and not protect you like those at the Belmopan Police Headquarters do, a high ranking officer whom you Menjivar, have at you disposal to do all what you say; you just tell him to jump and he asks how high.

    In respect to the GSU, a job well done and keep having those gangs tamed. I wonder when will you be a nation wide unit. Despite the people condemning you for what happened at Menjivar’s property, I bet you that if they were the ones in those uniforms, they would have done the same thing, maybe worse. They want a crime free Belize but still yet condemn the actions of the Belize Police Department when they are trying to suppress those who are involved in criminal activities. Menjivar is no one new to the Police system, he is not knew here in Las Flores Belmopan either.

    Point to note also, how comes Menjivar was allowed to have an interview from inside the jail? Where are the directors of that institution? You see what I mean? ask those prison wardens on duty how much they collected so that they can allow Menjivar to give an interview via cell phone. Still yet you keep biting at the Police.

    It is time that the Police Department stop being a civil police department and transform into a military type police, change all those high ranking officers who kiss the @$$#$ of those persons of questionable character, those who are well known for their illicit activities.

Even if they are partially at fault, don’t be distracted by the fact that this well known drug dealer from el salvador is running drugs thru and thru this country and has the potential to smear the whole reputation of our beautiful Garden City.     The police are all corrupt..i lived in Belize for fifteen years and there was not a cop i could not buy off.. they will steal, kill, falsify information, bully and abuse all freedoms in Belize..

    they are the most arrogant group of cops i ever had to deal with..from the chiefs to the little guy at the bottom.. i was picked up and dragged like a criminal into racoon street station because their cashier took my money for my gun permit and did not put it in the receipt book.. i got threatened and treated like $#!% by the corporal or whatever the hell he is and after two hours i showed them i had a receipt …

    violence and crime is the offspring of the people running the country and i walked away from hundred of thousands of dollars of realestate because i could not stand the corruption … the poor hard working people of Belize do not stand a chance… the greed from the power is insane.. a beautiful country with many nice people but, it will never end for generations to come.. get your kids out of the country anyway you can..     TEHRAN (AFP) – Iran has hanged 12 men for offences including murder, rape, armed robbery and drug trafficking, including five who were executed in public, news agency reports and a legal source said on Thursday.

    The official IRNA news agency said “serial killer” Mehdi Faraji, convicted of murdering five middle-aged women who boarded his minibus, was hanged in public in the city of Qazvin, northwest of the capital Tehran, on Thursday.

    Two more men, Hamid Ranjbar and Hamid Reza Baqeri, were also hanged in public after being convicted of armed robbery and abduction. They were executed in the southern city of Shiraz.

    Another two, Masoud Dehqan and Mehdi Alipour, were hanged in public in the same city after being found guilty of rape, the IRNA report added.

    In addition, two men convicted of drug trafficking were hanged on Thursday in a prison in the northern city of Sari, IRNA reported, quoting the city’s prosecutor Asadollah Jafari. The report did not name the convicts.

    Also, four men convicted of drug smuggling were sent to the gallows in a prison in the central city of Yasouj, IRNA cited a local prosecution official as saying, but did not name the men.

    Another man, meanwhile, was hanged on Monday for drug smuggling in the city prison of Behbahan in the southwestern province of Khuzestan, the provincial justice department said on its website. It gave no other details.

    You think it’s justified, for whatever reason, to go shoot up a child’s bedroom? That’s questionable material even for a D-Grade (disgusting) Hollywood gore fest. There are lines that should never be crossed and and there are some that have obviously been crossed here!

    Now your Government wants to ram through some “tough on crime” bill that will further erode the liberties and freedoms of both criminals and citizens alike. It’s only going to get worse unless you stand up and do something about it and you better start thinking about that real soon even though it’s probably too late!

    Mr. Vidal, there is no way on this earth that you can claim your goons are professionally trained. Just looking at photos of where the bullet holes are in the house and you have to wonder if your goons were shooting at their own shadows.

    Shame on you! Your raid stinks of reckless and dangerous rank amateurism compounded with live ammunition! Talk about a recipe for certain disaster. What could possibly go wrong with a hastily planned (and I use that term loosely) invasion (and I use that term in a succinct manner) based on questionable intelligence (now I’m really getting loose with the terms)? Mr. Vidal, you most certainly have horseshoes where they’re not normally found after you pull that fiasco out of the sump without tragic consequences.

    It’s a bloody miracle no one was killed and absolutely remarkable your goon squad didn’t end up filling each other with lead! Where is your head at man? I’ll bet where its at is dark and it don’t smell so good!

    I know there are opposing views here about whether or not Mike was a good guy or a bad guy or maybe even someone in between. So what! When you run a bar you’re for sure going to run into that! The first guy you have to eject out of your establishment cause he’s overly stimulated on Cane Juice and annoying the patrons is the guy you’re going to have to worry about taking revenge on you or your family for his perceived injustice. Now all the basturd has to do is to ring up the Goon Squad Unit with a “tip” and they gleefully rush in and do his bidding. How bloody convenient is that?

    When your law enforcement people start believing they have a “right” to “dish out justice” you have a serious problem on your hands. Lines have been crossed and it ain’t looking pretty for democracy as it was intended!

    I know Mike he’s not of good character ,he thinks he’s on top of things just because he owns that place. but, on my opinion that is not the way to carry an operation ,mennnn GSU sucks . obviously the man has the right to defend himself .he had a 45 caliber pistol? it was not necessary for the GSU to fire all those shots. now imagine if the GSU has to confront a gang having the same type of weapon as the GSU they would all die. one man made them take cover ,one man with a 45 caliber pistol on his hand.
    i definately don’t like police worst this so called “GSU” they think they are above the law they feel they can just do just anything . if the GSU feels they are above the law why the heck don’t they go and do the same $#!% to the real criminals. all the police dept. are racists ,they can see a blackman doing $#!% they think twice to act but, don’t it be a spanish dude cause he’s gonna take lick.
    i think the dogs they use are more smarter than the GSU. ,i think the dogs should train you guys.

    Doing the job properly is good for me but the GSU are operating like every other criminal gang in the world. They are using dark uniform and mask at night so anybody can mistake them for another criminal gang, bearing in mind that the Zetas and others from Guatemala are not far away. How can the members of the GSU convince me from behind a fence in total darkness that they are policemen without somebody in the regular police uniform and a clearly marked police vehicle. The Menjivar family had all the reasons to suspect that the invaders were not policemen and therefore the right to defend their home by all means necessary. Fortunately for the GSU, Mr. Mejivar missed them. I do not miss.
    Marco Vidal made me understand that they are wearing mask because they are cowards. If you are a coward, you do not belong in the police department. There is supposed to be a disciplinary charge for cowardice on the job.

    Has any one of our past or present governments of this country ever shown the people an ounce of fear? They have always quelled uprising with brutality. We have never had a government willing to hear the pleas of its people, they DICTATE (as in a dictatorship) to us the way that they will govern us. They call this a democracy? I say it’s a tyrannical dictatorship wrapped up in a sheep’s clothing of democracy. I have no qualms what so ever about what happened to Mike but what I have an issue with is in the fashion that it happened to him and the underlying reasons for it.
    We always make a political issue out of everything that happens in this country and with that said here we go… Mike was bank rolling a certain female (not the one that was in the police force) PUP political aspirant and this may have proved to be his undoing. With that said and given my disdain for the said political aspirant for her motives for wanting to seek political office and with the backing of the former prime minister and his lap dog Fundstaker; there is still the issue of right and wrong. Even with the unscrupulousness of Mikes backer (L.S) who runs around taking credit for her opponents in her own party (come on L.S don’t say no to this you know you took credit for the replacement of the front door and door frame of that poor little senior citizen knowing full well you had nothing to do with it) but what can we expect of her, remember SSB if not Google her name and SSB. But with that said this just goes to show you the Belizean people what politics does to us; it causes division (ever heard about divide and conquer?) between us and opens the door for the brutality without accountability that Mike happened to be the recipient of. When we cannot question our government for no reason at all (even though it concerns our very rights as taxpaying citizens) then we have officially turned away from a democracy and evolved into a dictatorship. You may say that this sounds like a political speech and I have taken a side. I say you are totally far from the truth and the point this is about our collective rights and has nothing to do with PUP or UDP (they are one of the same). You have been indoctrinated into a self impose ignorance and have been summarily brain washed. We have sold ourselves out so deeply in depth to the devil a$$ politicians that we have forgotten that we have constitutional rights (if you don’t know what those two words are look it up because it may sound perverse to you). My grandfather used to say that there will come a time when the government sends it’s assassins for any innocent person that stands in opposition of them and it took some time and incremental forward movement but that time is here and now, so welcome to UDPUP communism.     One can be Belizean by birth or by naturalization. The latter means, if any of ur parents are Belizeans and u are born elsewhere, you can apply for Belizean citizenship by descent or if you marry a Belizean, you can apply under those circumstances. There is no different types of Belizeans, just law abiding and criminals.

    There are two types of ignorant: one that is considered and the one (like you) who opens their mouth (and type discriminating and incriminating comments) without thinking or just so their mouth no stink.

    Lastly, the only people that are originally from Belize, are the MAYAS!!! Everyone else is “come-ya”.

    Everyone is so appalled that the police shot at the house with kids but their father started shooting knowing they were in there with him. What is wrong with him. There is more to this story and we don’t know it all. People are in their glee to see our country in this mess! What is wrong with you people. We are all Belizeans and it disgusts me to see how we bring politics into everything. Yes the police need better training but they also need to try with the present training and resources. Instead of finding fault with everything the government does, let’s try to criticize what really needs criticizing so that we can use our energies for more positive things. All the pudp’s need to stop their noise cause we know how they both do it. Bawl when the other side is in and put their tails between their legs n get fat when it’s their side in power. Most of us are sick of all of you. We want what is best for Belize, not what’s best for PUP or UDP. Same dogs, just different colors!

    I’ve known mike for 15 years, and he is of good character, and a very successful business man. He has no need of dealing with drugs. He has a mortgage for his house, and works 18 hours a day to make an honest living.
