Another witness fails to testify at trial
For the third time this week, an Attempted Murder case fell apart when the victims chose not to proceed with trial. Twenty year old Devain Flores, was accused of shooting nineteen year old Carl Lambey and his cousin twenty-three year old Kareem Gillett. But today Lambey told the court that he didn’t want to give evidence against Flores while Gillett said he wanted nothing to do with the case. Prosecutor Sheneiza Smith had no further evidence and Justice Herbert Lord directed the jurors to acquit Flores. The shooting incident occurred on January twenty-ninth, 2008 near the victims’ home at the corner of Allan Pitts Crescent and Caesar Ridge Road.


Change this stupid law ASAP
should have locked the two up for contempt of court and obstructing the course of justice. The crime was committed, regardless of whether the victim and a witness wants to testify or not! Attempted Murder is a crime!!!!!!!!
must be elections coming up, the prison floodgates are opening, so there are loads on the street to do the UDP & PUP’s dirty work!
nobody is protecting the witness from what the associates of these criminals will do, so what motivation do they have to testify. I would rather save my skin too..sorry….
Once a criminal case is reported and filed, it is the business of the people of Belize, not one individual. Every country has reluctant witnesses, but other countries enact laws to deal with them, such as by admitting the person’s previous statement and letting the defense cross-examine about it.
The stakes are too high for Belize’s future to allow cowardly or corrupted witnesses to sdet dangerous gangsters free.
These victims should be ordered to pay a heavy court cost when they wait until the matter is before the court to indicate that they dont wish to give evidence. laws need to be put in place to facilitate this.
He should be at the Prison Farm……………….
