Well known attorney taken to Court for not paying GST

Lionel Welch

Millions of dollars, at the last count, more than thirteen, are owed to the Sales Tax Department and they are cracking down on businesses that are in the red. In July a number of established businesses were issued with committal warrants for failure to pay. Well, today the Sales Tax took well-known attorney Lionel Welch to court for allegedly failing to pay taxes. According to the GST department, Welch has not made GST payments for his law firm for the period of January 2007 to June 2011.  The amount owed is not known but it amounts to forty-seven counts. When the matter came up, Welch was not present nor had he provided the court with a reason for his absence. Revenue Magistrate Ed Usher indicated he would be issuing a warrant for Welch to appear at the next adjournment. This afternoon Welch sent out a statement; he says the magistrate only intended to issue a bench warrant to ensure that he appears at the next hearing and that it was not a bench warrant for my arrest. According to Welch, after speaking with him, the Magistrate was satisfied that he was not aware that the matter was set for hearing today and hence did not proceed with the course of action. Welch also claims that this morning he was in the confines of the Magistrate Courts and the Registry of the Supreme Court when he heard about the bench warrant and that he immediately took up the matter with the Magistrate.  In a telephone call to the newsroom, Welch also said it has been cleared up meaning that the warrant has been called off.  Sales Tax first took the matter to court in 2010 but it was dismissed. There are two other instances when it came before the courts; as recent as two weeks ago when Welch also reportedly did not show up and on July twenty-sixth of this year when he asked to be excused.  The GST representative said in court that they have been unable to settle the matter with Welch despite attempts to so do.
