Retrial ordered for man sentenced for murdering his wife
Thirty-one year old Daniel Ku was sentenced to life imprisonment for the December 2006 murder of his common-law-wife, thirty-two year old nurse, Anna Basto in Orange Walk. Basto was stabbed thirty-two times and her throat was slashed three times; a heinous crime that Ku confessed to committing. Still, Ku appealed the decision and today the Court of Appeal ordered a retrial. His attorney, Simeon Sampson, sought to have the murder conviction reduced to manslaughter and a new sentence ordered. Sampson argued that the trial judge erred in law and misdirected the jury on the law of provocation, especially in the loss of self control. He added that the only evidence came from the accused himself in the caution statement to police, in which he confessed to killing Basto. Sampson also argued that Ku was intoxicated at the time of the incident and he had admitted during trial that he was drinking. But the Court of Appeal judges explained that there was not enough evidence on the level of alcohol that Ku had consumed. The position of the DPP’s office was that Ku should be granted a retrial, but Sampson felt that would not be favorable for his clients, since it would give the prosecution a chance to repair the flaws in their case for the second trial. In the end, the appeals judges quashed the murder conviction and a retrial was ordered. Ku’s relatives, who were present in court, are now concerned that he will once again be convicted of murder.

Give him the DEATH penalty.. (We need capital punishment)… He gave it to somebody and acted on it, so let him taste his own justice… Losing control is NO EXCUSE for killing somebody..
A guy who has killed once WILL kill AGAIN. My question is; What happens next time he losses control?? Make an example of this guy so that the people will think twice before committing a serious crime..

This is total nonsense!!!! IF he had the balls to kill his own wife what makes it safe for others… he shouldn’t be given a second chance! He lost it that day he committed this heinous crime! What if it was your family member that was killed you wouldn’t want him to be given a chance… the chance he took away from her simply because he lost control that is very much unacceptable! its total Bull! he should pay for what he has done!
He did the crime let him do the time….
