Judge disbelieves cop story
Cayetano will see 2012 behind bars; however, a teenager who happens to be a former police officer will not usher in the New Year behind prison walls. Police reported that on June ninth, the ex-cop ran and abandoned his bicycle because he allegedly had eight rounds of nine-millimeter ammunition in his possession.
Police also claimed that the accused had assaulted one of them with a scissors which prompted one of officers to shoot the former cop in his foot. But there were sharp differences between the testimony of nineteen-year-old ex-police constable, Dennis Carr and Sergeant Santiago Gongora who accused him of assault. At the conclusion of his trial, Senior Magistrate Sharon Frazer first did not ask Carr to answer the charge of kept unlicensed ammunition because there was no evidence against him. Carr offered testimony against the Aggravated Assault charge and that suit was also dismissed. Senior Magistrate Sharon Frazer acquitted Carr of both charges and she told the court that she was not convince that he assaulted Sergeant Gongora, but that the sergeant shot Carr without offering any justification. Senior Magistrate Frazer said that in the testimonies of the police officers, no one could say that they saw Carr throw anything in the nearby area, but yet when they conducted a search, they claim they found the ammunition. She also noted that during the trial, the evidence revealed when Carr was shot from the rear by Sergeant Gongora’s statement had a lot of inconsistencies. In his defense, Carr told the court that while near 88 Shopping Center on Central American Boulevard, officers in a vehicle jumped out and ran towards him. He ran because he had marijuana in his possession. After he was shot, he swallowed some of the weed and threw the rest into nearby bushes. He told the court that the sergeant told him he would plant a blade on him. Carr had previously lost his job as an officer when he was charged with theft of his ex-common law’s cell phone.
