Man sentenced to 38 years for Carnal Knowledge Conviction

Late Friday evening a forty year old man was convicted of sexually abusing an eight year old girl. Dangriga resident, Newellyn Nicholas, was on trial for three counts of Carnal Knowledge and one count of Aggravated Assault of an Indecent Nature for having sex with the child on three occasions between 2009 and 2010 as well as touching her inappropriately. During trial, the child gave an account of all three sexual encounters with Nicholas, but he denied the allegations and claimed that her mother was setting him up.  It took the jury of nine less than an hour to arrive at the unanimous guilty verdict on all counts. Today, Nicholas was back before Justice Troadio Gonzalez in the Dangriga Supreme Court to learn his fate. He was unrepresented and in mitigation, Nicholas called no character witnesses, but begged the court for leniency. Justice Gonzalez imposed a twelve year jail term for each count of carnal knowledge and two years for the Indecent Assault. The sentences are to run consecutively, which means Nicholas will spend a total of thirty-eight years in prison. The matter was prosecuted by Senior Crown Counsel, Cecil Ramirez.

    Are the sentences concurrent or consecutive? The story is confused on the point.

    Regardless, before he gets out, he — and ALL sexual attackers — should be castrated. It is the only way to make sure he doesn’t violate another one of our daughters.

    Finally some justice for at least one victim of sexual assault. Wish the rest of these criminals would receive similar sentences and keep them off the our streets and away from our children.

    That’s why we need THE PRISON FARM..aka…The SUSTAINABLE REHABILITATION CENTER,
    There HE can EARN HIS KEEP and CONTRIBUTE to SOCIETY at NO COST TO TAX-PAYERS…for the next 30 years. He could be very very productive.

    MaddSexyMother is right — every convicted sexual attacker should be identified in a public database, and required to provide his real residence address, so we know who is dangerous in the neighbourhood, and can protect our children properly.

    Proud Belizean, I agree with you! Although the child will need counseling, this gives a ray of hope for justice to other victims. This judge needs to preside over other cases of this matter. Perhaps all the sexual predators can be tossed in jail together where they can rot!

    I for one think Belize needs to apply tougher sentences for any violent crime. We should also implement a 2 or 3 strike law for violent offenders since its obvious by strike 2 or 3 that these criminals have no intention to reform. These guys have all proven themselves to be ticking time bombs. We wait for them to kill or rape again.

    This is what we should picket, march, protest for! Stiffer sentences for repeat offenders.
